Анотація
Виокремлено та надано характеристику ключовим принципам правового регулювання соціальних гарантій військовослужбовців. Наголошено, що принципами правового регулювання соціальних гарантій військовослужбовців є комплекс відправних начал, вихідних ідей, які визначають основний зміст регулювання правовідносин у відповідній сфері. Окрім того, саме принципи впливають на вектори розвитку соціальних гарантій досліджуваної категорії працівників. А відтак, відсутність законодавчого закріплення принципів правового регулювання соціальних гарантій військовослужбовців на законодавчому рівні є суттєвою прогалиною, яка негативно впливає на теоретичні дослідження за відповідним напрямом, а також на правозастосовну
практику. Саме тому відповідні принципи потребують закріплення як у загальному, так і спеціальному трудовому законодавстві.
The relevance of the article lies in the fact that today military servicemen can quite reasonably be considered a socially vulnerable category of the population, since the additional burdens placed on them in connection with the performance of military duty in confrontation with such an enemy as the Russian Federation are not always adequately provided with appropriate guarantees and compensations from the state and society. This also applies to those military personnel who are at "zero", as well as those who were injured or commissioned due to their health. That is why an important task of the legislator is to build an effective system of legal regulation of social guarantees of military personnel. At the same time, it is worth noting that the basis of this regulation is a system of starting principles, which are usually called principles. The purpose of the article is to establish the range of principles of legal regulation of social guarantees of military personnel under the labor legislation of Ukraine and to provide a meaningful description of them. The article, based on the analysis of the scientific views of scientists and the norms of the current legislation, singles out and characterizes the key principles of legal regulation of social guarantees of military personnel. Attention is focused on the fact that the lack of legislative consolidation of the principles of legal regulation of social guarantees of military personnel at the legislative level is a significant gap that negatively affects theoretical research in the relevant direction, as well as law enforcement practice. It was concluded that the principles of legal regulation of social guarantees of military personnel are a complex of starting points, initial ideas that determine the basic content of regulation of legal relations in the relevant field. In addition, the principles themselves influence the vectors of development of social guarantees of the studied category of workers. Therefore, the lack of legislative consolidation of the principles of legal regulation of social guarantees of military personnel at the legislative level is a significant gap that negatively affects theoretical research in the relevant direction, as well as law enforcement practice. That is why the relevant principles need to be enshrined in both general and special labor legislation.
