Анотація
З’ясовано, що фінансово-правовий статус військовослужбовця характеризує його стан у фінансових правовідносинах з державою, суспільством та окреслює коло прав, обов’язків та законних
інтересів на підставі норм фінансового права. Визначено особливості, які характеризують
правовий статус військовослужбовців, як осіб з особливими правами та обов’язками у суспільстві, які пов’язані з професійною діяльністю – захистом Вітчизни і залежать від їх забезпечення, зокрема і фінансового, отже як
учасників відносин з фінансово-правового захисту. Доведено, що до галузевих особливостей фінансово-правового статусу військовослужбовців належать особливі права, які реалізуються військовослужбовцями, як учасниками фінансових правовідносинах і які по’вязані з правами на фінансовий захист його інтересів.
Based on the analysis of the positions of scientists regarding subjects of financial law and financial legal relations, the concepts of "legal status", "legal personality", and "financial legal personality", it was determined that the category "financial and legal status" has a collective, generalized character in in the field of public relations. It was found that the financial and legal status of a military serviceman characterizes his state in financial legal relations with the state and society and outlines the circle of rights, obligations and legitimate interests based on the norms of financial law. Taking into account the opinions of scientists, one should pay attention to the presence in the scientific literature of views on the concept of "legal status" in a broad and narrow sense, as well as on the branch specifics of legal status. Sharing the conclusion regarding the importance of ensuring the signs of the legal status of an individual with legal guarantees, it is taken into account that a special legal status is realized in specific circumstances, working conditions, living conditions and the type of person, which affects his rights and obligations. Therefore, when determining the types of legal status of a serviceman, it is important to establish the elements of the legal status structure depending on the circumstances of professional activity. Analyzed features defined by law that characterize the legal status of military personnel, as persons with special rights and responsibilities in society, which are related to professional activity - defense of the Motherland and depend on their support, in particular financial, therefore as participants in relations with financial legal protection. It was found that financial and legal protection in accordance with the current regulatory legal acts covers military personnel, whose characteristic is the completion of military service and the performance of military duty, and since they have a financial legal personality - the right to special financial support, benefits, guarantees and compensations, a separate financial and legal status is drawn up. It has been proven that special rights exercised by military personnel as participants in financial legal relations and related to the rights to financial protection of their interests are among the specific features of the financial and legal status of military personnel.
