dc.description.abstractПроаналізовано зміст права участі в управлінні господарським товариством шляхом встановлення системи правомочностей, що його складають. На підставі проведеного дослідження зроблено висновок, що досліджуване право складають правомочності: участі у підготовці до проведення загальних зборів; брати участь у загальних зборах учасників господарського товариства; голосувати з усіх питань порядку денного загальних зборів; правомочність вимагати проведення позачергових загальних зборів учасників.uk_UA
dc.description.abstractThe attempt of carrying out the analysis of the content of the right of the participation in management of economic society, that is to install system of competences that it composed of, is made in the article. On the basis of the conducted research the author draws a conclusion that the studied right consists of the competences: of participation in preparation for carrying out general meeting; to take part in general meeting of participants of economic society; to vote on all questions of the agenda of general meeting; to demand carrying out extraordinary general meeting of participants. The author notes that realization of every power composing the content of the right on participation in a business entity’s management is implemented according to its mechanism. As a result violation of such powers in the whole constitutes a violation of the researched subjective corporate right. Interrelation of the powers of the right on participation in a business entity’s management is caused by the inability of their self-realization; otherwise it would lead to the need for considering them as independent subjective corporate rights. It is proved that realization of the right on management in all cases it is needed to realize the right of a participant of a business entity on information (about his/her rights, about the calling of a general meeting of the members, about the decision of agencies of a business entity, etc.). The author pays attention that according to the common rule agencies are elected at the general meeting of the participants; their powers are terminated at the same meeting, so the grounds of formation, modification and termination of powers of the participants in the sphere of management must also include the competence of the highest managing agency of a business entity.en
dc.description.abstractПроанализировано содержание права участия в управлении хозяйственным обществом путём установления системы составляющих его правомочий. На основании проведённого исследования сделан вывод о том, что исследуемое право составляют правомочия: участия в подготовке к проведению общего собрания; принимать участие в общем собрании участников хозяйственного общества; голосовать по всем вопросам повестки дня общего собрания; требовать проведения внеочередного общего собрания участников.ru
