dc.description.abstractРозглянуто проблемні питання інституту сприяння осіб оперативним підрозділам у протидії злочинності. Проаналізовано різні точки зору на значення інституту сприяння осіб для оперативно-розшукової діяльності. Наведено класифікацію сприяння осіб. Розглянуто окремі терміни, що відображають сутність цього інституту. Здійснено ретроспективний аналіз стану конфіденційного співробітництва у радянський період вітчизняної історії. Запропоновано шляхи удосконалення інституту сприяння осіб оперативним підрозділам в умовах сучасності.uk_UA.UTF8
dc.description.abstractSome issues of the institution of people assistance to operative units in counteracting crime are studied in the article. It is found out that many countries gradually move away from the practice of restricting access to such sensitive topic as persons’ cooperation with law enforcement agencies, introducing conceptual issues of is regulation to the current legislation. Different points of view on the importance of the institution of people assistance for operative and search activity are analyzed. Classification of people assistance is provided. In particular, it may be direct or indirect; short and long term; open and secret. Some specific terms reflecting the essence of this institution are studied. It is found out that the meaning of the notion open assistance it is necessary to consider not only the citizens but subjects; attention is also focused on the fact that both individuals and legal entities may assist operative and search units on the open basis according to the national legislation. Retrospective analysis of confidential cooperation in the Soviet period of the national history is realized on the basis of declassified data about the USSR in the late 40’s – mid 50-ies of the previous century. The ways of improving the institution of people assistance to operative units in terms of modern time are offered. The author offers to resolve the issue of authorized agents’ participation in certain categories of offenses, to consolidate compulsory presence of a witness while paying remuneration to agents, to adopt in the current legislation a provision, under which a certain percentage of the value of confiscated property by a court decision illegally gained would be passed to an operative officer, who solved the offense and to an agent, who actively assisted to the investigation. Besides, it is offered to amend the Law of Ukraine «On Operative and Search Activity» concerning the possibility to involve persons under the age of 18 to confidential cooperation, which is extremely important in cases of organized crime of minors.en
dc.description.abstractРассмотрены проблемные вопросы института содействия лиц оперативным подразделениям в противодействии преступности. Проанализированы разные точки зрения на значение института содействия лиц для оперативно-розыскной деятельности. Приведена классификация содействия лиц. Рассмотрены отдельные термины, которые отображают сущность этого института. Осуществлен ретроспективный анализ состояния конфиденциального сотрудничества в советский период отечественной истории. Предложены пути усовершенствования института содействия лиц оперативным подразделениям в условиях современности.ru
