dc.description.abstractУ дисертації наведено теоретичне узагальнення та нове вирішення наукової проблеми, що виявляється в розробленні методики розслідування самовільного присвоєння владних повноважень або звання службової особи. Запропоновано теоретичну концепцію формування та реалізації криміналістичної характеристики самовільного присвоєння владних повноважень або звання службової особи. Виокремлено та розкрито зміст таких елементів криміналістичної характеристики, як способи вчинення, особа злочинця, особа потерпілого, слідова картина (час, місце, обстановка, типові сліди). Підкреслено, що методику розслідування самовільного присвоєння владних повноважень або звання службової особи необхідно будувати з урахуванням принципу періодизації. Виокремлено три етапи розслідування вказаних кримінальних правопорушень. Визначено та систематизовано обставини, що підлягають з’ясуванню під час розслідування самовільного присвоєння владних повноважень або звання службової особи. Виокремлено типові слідчі ситуації та тактичні завдання для кожного з етапів розслідування. Запропоновано відповідні ситуативно обумовлені алгоритми дій слідчого. Розглянуто особливості тактики проведення окремих слідчих (розшукових) дій. Визначено специфіку підготовки та призначення судових експертиз.uk_UA
dc.description.abstractThe dissertation presents a theoretical generalization and a new solution to a scientific problem that manifests itself in the development of methods of investigating the unauthorized assignment of authority or the rank of an official. It is noted that the unauthorized assignment of authority or the rank of an official affects the normal activities and authority of public authorities and local self-government bodies. It is emphasized that the mechanism of making these crimes is characterized by the fact that the latter are always committed in combination with other offenses. Accordingly, these criminal acts always carry out the role of predicate crime in technologies of illegal activity, is a way of preparing the main socially dangerous act. It is argued that the investigation of these criminal offenses is a prerequisite for the development of recommendations for timely detection and effective investigation. The concept of criminalistics characteristics of these crimes and its structure are formulated. The author proposed to understand such characteristics as the system of criminalistically meaningful information about the elements of the mechanisms of committing a distinguished category of criminal offenses, which plays an indicative role in the activities of pre-trial investigation bodies in determining the main directions and means of conducting their investigation. It is emphasized that the methods for investigating the unauthorized assignment of authority or the official's title must be based on the principle of periodization. Three stages of the investigation of the said criminal offenses are identified. It is proposed to distinguish the circumstances to be clarified among the structural elements of the appropriate criminalistics methods of investigation of such crimes. The author points out the need to systematize the circumstances to be clarified during the investigation of the said criminal offenses considering the legally established the subject of proof in the criminal proceedings, described in the criminal law of the composition of the crime and the mechanism of their commission. The author suggests to distinguish three groups of circumstances to be clarified: circumstances connected with the event of crime; circumstances related to the person of the offender; other circumstances. Criminalistics typical situation and tactical tasks for each stage of the investigation are singled. It has been established that in order to optimize the pre-trial investigation of the unauthorized assignment of authority or the official's title, the investigator interacts with the authorized officer of the duty station, the prosecutor, operational units, patrol police response groups, district police officers, persons known to be familiar with the media, the public and enterprises, institutions and organizations of all forms of ownership.The author formulated the features of tactics of some investigative (detective) actions. It is proposed to highlight such typical investigative (search) actions for the investigation of unauthorized assignment of authority or the official's official rank as verbal (interrogation, presentation for identification) and non-verbal (investigative review and search, temporary seizure of property, temporary access to things and documents, investigative experiment) actions. In a separate group, the use of opportunities of forensic examinations is allocated. It was stated that during the investigation of the unauthorized assignment of authority or the official's title, there is a need for the active use of special knowledge in the form of involving an expert to ensure its comprehensiveness and reliability. The peculiarities of preparation and appointment of forensic examinations are determined.en
dc.description.abstractВ диссертации предложена теоретическая концепция формирования и реализации криминалистической характеристики самовольного присвоения властных полномочий или звания должностного лица. Выделены и раскрыто содержание таких элементов криминалистической характеристики, как способы совершения, личность преступника, личность потерпевшего, следовая картина (время, место, обстановка, типичные следы). Подчеркнуто, что методика расследования самовольного присвоения властных полномочий или звания должностного лица необходимо строить с учетом принципа периодизации. Выделены три этапа расследования указанных уголовных правонарушений. Определены и систематизированы обстоятельства, подлежащие выяснению при расследовании самовольного присвоения властных полномочий или звания должностного лица. Выделены типичные следственные ситуации и тактические задачи для каждого из этапов расследования. Предложены соответствующие ситуативно обусловлены алгоритмы действий следователя. Рассмотрены особенности тактики проведения отдельных следственных (розыскных) действий. Определена специфика подготовки и назначения судебных экспертиз.ru
