dc.description.abstractРозглянуто сучасні підходи до трактування таких понять, як «принципи права» та «державний контроль». Встановлено, що значна кількість наукових поглядів не знайшла свого висвітлення у питанні принципів державного контролю у сфері зв’язку. Наголошено, що чинні нормативно-правові акти не дають чіткого поняття сфери (галузі) зв’язку, що є недоліком законодавства. Уточнено та запропоновано авторське бачення переліку та змісту принципів державного контролю в Україні. Зроблено висновок про роль принципів державного контролю у досліджуваній сфері.uk_UA
dc.description.abstractThe topic of the research is principles of the state control in the sphere of communications. The objective of this article is to clarify the list and content of principles of the state control in the sphere of communications of Ukraine. The principles underlying the state control in the field of communications are defined as leverages of guaranteeing the stable operation of the studied area. Following the principles of the state control is the key to the efficiency and effectiveness of the state control in the sphere of communications in today’s conditions. Current approaches interpreting such categories as law principles, state control are studied in the article. It is concluded about the unity of scientific views on the issue of principles, which are offered in the legal literature to understand as the basic principles, ideas that are taken as a basis. However, a significant number of scientific views did not find their coverage in the issue of principles of the state control in the sphere of communications. It is emphasized that nowadays that current normative and legal acts do not provide a clear notion of the sphere (branch) of communications, which is a lack of the legislation. The author’s point of view of the list and content of the principles of the state control in the sphere of communications of Ukraine is specified and offered. That list is suggested to include: rule of law, centralism and independence in decision making, regulatory bodies’ activities planning, professionalism, science, control reality, control objectivity, completeness and complexity, materiality, impartiality, effectiveness, efficiency, transparency and formality, cooperation between controlling authorities and with law enforcement agencies, assistance to controlled structure to correct errors, the burden of evidence collection, liability of control authority under the state and controlled structure. The practical significance of the work lies in the application of the conclusions obtained by the author while practicing during the state control realization in the sphere of communication of such a control’s subjects. The conclusion about the role of the principles of the state control in the researched area is made.en
dc.description.abstractРассмотрены существующие подходы к трактовке понятий «принципы права» и «государственный контроль». Установлено, что значительное количество научных взглядов не нашло своего освещения в вопросе принципов государственного контроля в сфере связи. Отмечено, что действующие нормативно-правовые акты не дают чёткого понятия сферы (отрасли) связи, что является недостатком законодательства. Уточнены и предложены авторские видения перечня и содержания принципов государственного контроля в Украине. Сделан вывод о роли принципов государственного контроля в исследуемой сфере.ru
