Анотація
Визначено функціональний зміст завдань і функцій суб’єктів протидії корупції в Україні. Сформульовано авторський підхід до визначення завдань суб’єктів протидії корупції, під якими розуміється набір конкретних дій, які визначені для різних установ, організацій, агентств та інших суб’єктів, які беруть участь у протидії корупції. Ці дії спрямовані на запобігання, виявлення та припинення корупційних діянь у різних
сферах суспільства. Встановлено сутність категорій «завдання суб’єктів протидії корупції» і «функції суб’єктів протидії корупції», розглянуто коло завдань та функцій суб’єктів протидії корупції в Україні. Виокремлено ключові аспекти вдосконалення законодавства, яке регулює завдання та функції суб’єктів протидії корупції в Україні.
The article emphasizes that the research and analysis of the tasks and functions of anticorruption entities in Ukraine is extremely important, since corruption remains one of the main threats to the country’s development and violates the principles of justice, transparency and equality. It is noted that the importance of understanding the essence of the tasks and functions of the entities involved in combating corruption is revealed in the unity of the following key aspects: ensuring the effectiveness of actions; ensuring transparency and openness; increasing public confidence; stimulation of the economic development of society; increasing international reputation; ensuring the unity of science and practice and improving law-making activity. The author’s approach to defining the tasks of anti-corruption subjects, by which we mean a set of specific actions that are defined for various institutions, organizations, agencies and other subjects involved in anti-corruption, is formulated on the basis of understanding the views of scientists and reference literature. These actions are aimed at preventing, detecting and stopping corrupt acts in various spheres of society. It is noted that the tasks of anti-corruption entities in Ukraine include prevention of corruption and detection and investigation of corruption offenses; control and supervision are included in the function of anti-corruption entities from the point of view of general administrative law; conducting anti-corruption investigations; educational activity. It was noted that political pressure and insufficient quality legislative support affect the weakening of the anti-corruption process in Ukraine due to several reasons, including insufficiently effective institutions, political pressure, lack of funding and resources, lack of public support, and insufficient international cooperation. It is claimed that in order to improve the effectiveness of the anti-corruption and law enforcement agencies of Ukraine and eliminate the above-mentioned shortcomings, it is necessary to improve the current legislation regulating the tasks and functions of anti-corruption entities. The key aspects of such improvement are singled out in view of their impact on the process of combating corruption in Ukraine, in particular, the expansion of the powers of the NAKC, the increase of transparency and openness in government, the development of civil society, and international cooperation.
Определено функциональное содержание задач и функций субъектов противодействия коррупции в Украине. Сформулирован авторский подход к определению задач субъектов противодействия коррупции, под которыми понимается набор конкретных действий, определенных для различных учреждений, организаций, агентств и других субъектов, участвующих в противодействии коррупции. Эти действия направлены на предотвращение, выявление и прекращение коррупционных деяний в разных сферах общества. Установлена сущность категорий «задания субъектов противодействия коррупции» и «функции субъектов противодействия коррупции», рассмотрен круг задач и функций субъектов противодействия коррупции в Украине. Выделены ключевые аспекты совершенствования законодательства, регулирующего задачи и функции субъектов противодействия коррупции в Украине.
