Анотація
Розкрито загальнотеоретичні підходи щодо визначення видів соціальних гарантій військовослужбовців в Україні. Запропоновано авторське бачення переліку видів соціальних гарантій військовослужбовців. Акцентовано увагу на тому, що важливим напрямком діяльності законодавця є систематизація соціальних гарантій військовослужбовців, що в свою чергу спростить правозастосовну практику у відповідній сфері. Визначено, що
основними завданнями загальнодержавних програм забезпечення житлом військовослужбовців є: 1) вирішення проблеми забезпечення житлом усіх категорій військовослужбовців, які мають право на отримання службового житла; 2) удосконалення порядку надання такого житла військовослужбовцям, шляхом спрощення процедури; 3) підтримка створення фонду житла; 4) спрощення процедур фінансування програми, шляхом створення «прозорих» механізмів; 5) безпосереднього залучення меценатів та закордонних інвесторів; 6) посилення контролю та нагляду за порядком надання службового житла військовослужбовців з метою зменшення адміністративного тиску та інших проявів корупції у цій сфері. З’ясовано, що із набуттям спеціального правового статусу військовослужбовця, такі
особи наділяються розгалуженим колом гарантій, які забезпечують ефективний соціальний захист цієї категорії працівників.
The relevance of the article lies in the fact that today it is military personnel who play a key role in Ukraine’s defense capability, ensuring its security, protecting and preserving sovereignty and territorial integrity. In view of this, an important task for the state is to ensure a high level of their social and legal protection. The above is determined by the fact that it is with the help of the latter that it is considered possible: 1) to ensure the appropriate level of social security and support for military personnel, as well as their family members; 2) to motivate military personnel to better perform their duties; 3) create favorable conditions to encourage citizens to join the ranks of the Armed Forces of Ukraine; 4) increase the prestige of the military service, as well as the general level of trust of the population in the Armed Forces of Ukraine and the state. The article, based on the analysis of the scientific views of scientists, reveals general theoretical approaches to determining the types of social guarantees of military personnel in Ukraine. The author’s vision of the list of types of social guarantees for military personnel is proposed. Attention is focused on the fact that an important direction of the legislator’s activity is the systematization of social guarantees for military personnel, which in turn will simplify law enforcement practice in the relevant field. It was determined that the main tasks of the national programs for providing housing for military personnel are: 1) solving the problem of providing housing for all categories of military personnel who have the right to receive service housing; 2) improvement of the procedure for providing such housing to servicemen by simplifying the procedure; 3) support for creating a housing fund; 4) simplification of program financing procedures by creating "transparent" mechanisms; 5) direct involvement of patrons and foreign investors; 6) strengthening control and supervision of the procedure for providing official housing for military personnel in order to reduce administrative pressure and other manifestations of corruption in this area. It was found that with the acquisition of the special legal status of a military serviceman, such persons are endowed with an extensive circle of guarantees that ensure effective social protection of this category of workers. It is also worth noting that the list of types of social guarantees of military personnel given in the article is not exhaustive, however, they are the ones that most meaningfully reveal the essence and meaning of this direction of state activity. That is why an important area of activity of the legislator is the systematization of social guarantees of military personnel, which in turn will simplify law enforcement practice in the relevant field.
