Анотація
У статті наголошено на тому, що наявність чітко визначених компетенцій та повноважень у законодавстві є ключовою для протидії корупції. Зазначено, що наявність чіткого розподілу ролей (повноважень і компетенцій) між суб’єктами протидії корупції, особливо між спеціалізованими антикорупційними органами, їх взаємодія з традиційними правоохоронними органами загального призначення сприяє ефективному прийняттю рішень. Визначено співвідношення компетенції та повноважень суб’єктів протидії корупції. Проаналізовано особливості реалізації повноважень Національним антикорупційним бюро України. Наведено шляхи удосконалення компетенції і повноважень суб’єктів протидії корупції.
The article emphasizes that the presence of clearly defined competences and powers in legislation is key to combating corruption. It is noted that the presence of a clear division of roles (powers and competencies) between anti-corruption entities, especially between specialized anti-corruption bodies, their interaction with traditional law enforcement bodies of general purpose contributes to effective decision-making. The essence of the term «competence», which combines such concepts as «powers», «tasks» and «functions», is analyzed. This category characterizes the content and scope of the rights and obligations of one or another anti-corruption subject in a certain sphere of social relations over which such a subject has influence. Key approaches to the interpretation of the category «authority» from various dictionaries, including foreign ones, are presented. An analysis of these definitions allows us to realize that the category «authority» indicates the right or permission to perform certain actions that can be provided in accordance with the law. Based on the analysis of the opinions of modern scientists in the field of administrative law, it is indicated that the most objective approach to determining the subject’s competence, which is used in the modern theory of administrative law, is the separation of two elements in its structure: powers and functions, which also determine the subject accountability of the entity endowed with the relevant competence. It is claimed that the body’s sphere of activity should be reflected in its competence and be legally justified. An indispensable element of competence is authority, which, on the one hand, is a direct expression of the power granted by the state, and on the other hand, is a specific feature of the bearer of the corresponding competence. It was determined that the competence of a state body is a set of powers established by law to perform the functions and tasks assigned to it by the state, and the powers are a set of rights and duties of the body. On the basis of the cited views of scientists and the author’s statements, the author’s vision of certain directions for improving the competence and powers of the subjects of anticorruption in Ukraine is proposed.

Указано, что наличие четкого распределения ролей (полномочий и компетенций) между субъектами противодействия коррупции, особенно между специализированными антикоррупционными органами, их взаимодействие с традиционными правоохранительными органами общего назначения способствует эффективному принятию решений.
