dc.description.abstractВизначено, що правовий статус дитини у житлових правовідносинах (житлово-правовий статус) – це стан дитини у межах житлових правовідносин, який включає правосуб’єктність дитини (правоздатність, дієздатність, продієздатність, деліктоздатність); суб’єктивні права та юридичні обов’язки щодо житла; механізм сприяння у здійсненні та захисті житлових прав. dc.description.abstractThe relevance of the article’s theme is grounded by the fact that a child actually participates in housing legal relations; however, its status is not defined in the legislation. Herewith the jurisprudence has not found features of legal personality of a child within housing legal relations. The objective of this article – is to identify the features of the legal status of a child within housing legal relations. The following definitions as «a child», «housing legal relations», «legal status», «legal personality», «subject of law», «subject of legal relations» have been considered in the article. It is proved that the mentioned legal categories have certain characteristics regarding a child. Consideration of the legal status of a child is separated within housing legal relations, under which the author of the article understands the social legal relations, regulated by the norms of housing legislation arising from the ownership, use, management of housing. Mentioned triad of powers does not provide disposal as housing disposal belongs to the civil legal relations and does not need to implement an integrated approach, as it is required by the competences of housing legal relations. It is suggested to consider the legal status ofa child within housing legal relations (housing and legal status) as a state of a child within housing legal relations, which includes legal personality of a child (capacity, legal capability, pro-legal capability, delictual dispositive capacity); subjective rights and legal responsibilities concerning housing; the mechanism of assistance in the implementation and protection of housing rights. This status is divided into: the legal status of a child – the owner of housing; status of a child – family member of the owner of housing; status of a child as a family member of the tenant; the legal status of a child who has lost parental care.en
