dc.description.abstractНа основі порівняльного аналізу норм Конституції України, рішень Конституційного Суду України, постанов Пленуму Верховного Суду України, а також положень Кримінально- процесуального кодексу України 1960 р. і Кримінального процесуального кодексу України 2012 р. досліджено проблемні питання здійснення захисту прав, свобод та законних інтересів особи у кримінальному провадженні. З урахуванням цього сформовано та запропоновано певні шляхи вирішення існуючих на сьогодні законодавчих протиріч.ru_RU.UTF8
dc.description.abstractBased on the comparative analysis of the Constitution of Ukraine, judgments of the Constitutional Court of Ukraine, decisions of the Supreme Court of Ukraine, and the provisions of the Criminal and Procedural Code of Ukraine dated from 1960 and the Criminal Procedural Code of Ukraine dated from 2012 the author has studied the issues ofprotecting the rights, freedoms and legitimate interests of individuals in criminal proceedings. The above mentioned is due to the fact that the adoption of the Criminal Procedural Code of Ukraine in 2012 set rather difficult task for the scientists and practitioners, particularly proper development, rethinking and understanding concerning the application of new provisions, requirements and principles, which it had laid. It is necessary to establish such criminal proceedings that would function on the basis of the objective perception of procedural status of each participant in the criminal proceedings. Thus, an investigator must fully and impartially investigate the criminal proceedings, a prosecutor has to realize proper supervision over the compliance with statutory requirements and a defender, representative and legitimate representative must conscientiously protect the rights, freedoms and legitimate interests of others. This is because distinction between the prosecution and defense was accomplished for the first time in the current legislation. It is stated that the uncertainty of a clear procedural status of persons, who are authorized to protect the rights and represent legitimate interests of other participants of criminal proceedings provides the right for the subjects a certain freedom in interpreting the provisions of the Criminal Procedural Code of Ukraine.en
dc.description.abstractНа основе сравнительного анализа норм Конституции Украины, решений Конституционного Суда Украины, постановлений Пленума Верховного Суда Украины, а также положений Уголовно-процессуального кодекса Украины 1960 г. и Уголовного процессуального кодекса Украины 2012 г. исследованы проблемные вопросы осуществления защиты прав, свобод и законных интересов личности в уголовном производстве. С учетом этого сформированы и предложены определенные пути решения существующих на сегодня законодательных противоречий.ru
