dc.description.abstractСтаттю присвячено проблемним питанням правозастосування такого заходу забезпечення кримінального провадження, як тимчасовий доступ до речей і документів, який є новелою для теорії кримінального процесу та правозастосовної діяльності.uk_UA
dc.description.abstractThe article is devoted to the problematic issues of law enforcement of such a measure for the provision of criminal proceedings, as temporary access to things and documents, which is a narrative for the theory of criminal process and law enforcement activities. Legislative inaccuracies and contradictions regarding the procedural order of the application of this measure have been clarifed. Certain suggestions and recommendations for improving the procedural form of temporary access to things and documents are scientifcally substantiated. It was emphasized that it would be expedient to provide the investigating judge with the original documents or duly certifed copies of them and other materials by a party to the criminal proceedings, who applied for temporary access to things and documents. This, in our opinion, will facilitate a more reasonable and well-judged decision by the investigating judge on granting permission to temporarily access things and documents. It is concluded that temporary access to things and documents is a universal legal instrument, since it can be applied in any criminal proceeding, regardless of the severity of the criminal offense committed by both the prosecution party and the defense party. Temporary access to things and documents, in contrast to the demand and receipt of things, documents and information in the manner prescribed by art. 93 CPC of Ukraine, characterized by a greater degree of restriction of rights, freedoms and legitimate interests of a person. Thirdly, unlike the demand and receipt of things, documents, information, which in the provisions of Art. 93 CPC of Ukraine has only a declarative character, the procedural procedure for temporal access to things and documents is more regulated in chapter 15 of the CPC of Ukraine.en
