Анотація
Проаналізовано ключові проблеми правового встановлення в предметі цивільного права деяких
цивільних відносин у сфері венчурного інвестування. Розроблено можливі шляхи їх вирішення для покращення стану правової визначеності в механізмі цивільно-правового регулювання.
The article analyzes the problem of the lack of a clear regulatory regulation of some private legal relations in the field of venture investment in the civil legislation of Ukraine, in particular those relating to the enterprise as a single property complex. The author emphasizes that such relations are not clearly regulated by the Civil Code of Ukraine, since the existing criteria for civil relations do not allow them to be unambiguously defined in the subject of civil law regulation. The author of the article draws attention to the critical problem that arises from the criteria that are put forward today by the legislator to the objects of civil rights, and do not allow to clearly identify the enterprise as a single property complex in the system of objects of civil rights. According to them, such a good cannot be unequivocally attributed either to the category of material goods or to the category of intangible goods. This legal uncertainty makes it difficult to identify the relevant legal relations as civil, since the key condition for this is a clear definition of the object of legal relations in the system of objects of civil rights. The author concludes that the imperfection of existing normative definitions complicates the legal regulation of relations related to venture investment, which requires further improvement of legislation in this area.
Проанализированы ключевые проблемы правового установления в предмете гражданского права некоторых гражданских отношений в сфере венчурного инвестирования. Разработаны возможные пути их решения для улучшения состояния правовой определенности в механизме гражданско-правового регулирования.
