dc.description.abstractСтаття присвячена проблемам встановлення кримінальної відповідальності за злочини у сфері земельних відносин. Наведено визначення поняття «земельні злочини» як основного термінологічного обороту злочинів у сфері земельних відносин. Названо передумови виникнення кримінальної відповідальності за злочини, пов’язані із земельними ресурсами. Розглянуто об’єктивні та суб’єктивні ознаки загального складу земельних злочинів. Окреслено шляхи протидії злочинам у сфері земельних відносин.uk_UA.UTF8
dc.description.abstractThe current state of the environment in general and land resources is characterized by extremely negative indicators. This situation can be changed by the way of mobilization of the efforts of entire society and the state. The state realizes the steps towards ensuring adequate protection of natural resources by guaranteeing execution of the established regulations in this area. One of these steps is to establish criminal liability for a certain group of socially dangerous encroachments, characterized by the encroachment on land resources. The objective of the study is to address the problematic aspects of criminal liability for criminal violations taking place in the sphere of land relations. The problem of criminal and legal protection of land resources in Ukraine is quite relevant today. This is related to the role that play land resources in modern society. The increasing stress on land resources, including socially dangerous encroachments, requires decisive steps from the state to ensure adequate legal protection of this object of environment. One of the main forms of implementing measures of legal protection of land resources – is further development of criminal liability for socially dangerous encroachments on this object of environment. Criminal liability for crimes in the land sector is a necessary step to combat crime in this area. It is set for a comprehensive list of socially dangerous acts provided in the Section VIII “Crimes against the Environment”. Considering the importance of land resources for the country and society, as evidenced by the Basic Law, it is appropriate to allocate the designated group of criminal and legal norms into a separate section – “Crimes in the Sphere of Land Relations”.en

Дано определение понятия «земельные преступления» как основного терминологического оборота преступлений в сфере земельных отношений. Указаны предпосылки возникновения уголовной ответственности за преступления, связанные с земельными ресурсами. Рассмотрены объективные и субъективные признаки общего состава земельных преступлений. Очерчены пути противодействия земельным преступлениям.ru
