Анотація
Висвітлено результати історичного огляду проблеми застосування хімічної та біологічної зброї в умовах воєнного стану. Проаналізовано праці науковців щодо кримінальних правопорушень проти миру та міжнародного правопорядку, визначено, що норми міжнародного кримінального права порушуються і можливість застосування країною-агресором забороненої зброї зростає. Аналіз історичних фактів використання хімічної та біологічної зброї, наслідків її застосування дає можливість розробити комплекс організаційних, інженерних, медичних та інших заходів, спрямованих на запобігання або максимально можливе ослаблення вражаючої і руйнуючої дії зброї масового ураження з метою збереження життя, здоров’я, боєздатності і працездатності особового складу військ і населення, а також збереження військових, цивільних і природних об’єктів, тварин і матеріальних цінностей. Розглянуто тактику дій для захисту у разі її застосування. Наголошено на необхідності якісної підготовки підрозділів Медичних сил Збройних Сил України, закладів охорони здоров’я, працівників ДСНС та Національної поліції до захисту особового складу та населення в разі застосування хімічної та/або біологічної зброї.
The war in Ukraine actualized the problem of using weapons of mass destruction, in particular biological and chemical. Such weapons have been used in wars in the past. As early as 1968, humanity, realizing the terrible consequences of chemical and biological weapons, began to discuss the prohibition of their use. In order to achieve effective progress towards general and complete disarmament under strict and effective international control, including the prohibition and elimination of all types of weapons of mass destruction, in 1993 countries began to sign the Convention on the Prohibition of the Development, Production, Stockpiling, Use of Chemical Weapons and on Their Destruction. Also, the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxic Weapons and on Their Destruction prohibited the use of biological weapons. But not all countries that have signed these conventions adhere to them, including russia. Therefore, it became necessary to analyze cases of the use of such weapons and the consequences of their use, to develop action tactics to preserve the life and health of the civilian population, employees of the security and defense sector, and the Armed Forces of Ukraine. The purpose of the article is to highlight the results of a historical review of the problem of the use of chemical and biological weapons under martial law. Analyzing the works of scientists regarding criminal offenses against peace and the international legal order, it was determined that the norms of international criminal law are being violated and the possibility of using prohibited weapons by the aggressor country is increasing. The analysis of the historical facts of the use of chemical and biological weapons and the consequences of their use makes it possible to develop a complex of organizational, engineering, medical and other measures aimed at preventing or as much as possible weakening the impressive and destructive effect of weapons of mass destruction in order to preserve life, health, fighting capacity and operational efficiency of the personnel of the troops and the population, as well as the preservation of military, civilian and natural objects, animals and material values. tactics of actions for protection in case of its application. The conclusion emphasizes the need for high-quality training of units of the Medical Forces of the Armed Forces of Ukraine, health care institutions, employees of the State Emergency Service and the National Police to protect personnel and the population in the event of the use of chemical and/or biological weapons.
Отражены результаты исторического обзора проблемы применения химического и биологического оружия в условиях военного положения. Проанализированы труды ученых по уголовным правонарушениям против мира и международного правопорядка, определено, что нормы международного уголовного права нарушаются и возможность применения страной-агрессором запрещенного оружия растет.
