dc.description.abstractУ статті розглянуто окремі питання забезпечення захисту учасників кримінального провадження. Здійснено характеристику міжнародно-правових актів та порівняльно-правовий аналіз положень КПК України 1960 та 2012 рр., що стосуються досліджуваного інституту. Автор на підставі розроблених міжнародною спільнотою документів доходить висновку, що зближення національного законодавства з цими стандартами є природним і потрібним. Обґрунтовано доконечну потребу систематизації та осмислення науковцями й практиками наявного фактичного та наукового матеріалу з окреслених питань. Визначено прогалини законодавчого регулювання та пріоритетні напрями досліджуваного інституту.uk_UA
dc.description.abstractThe article deals with some actual issues of protection of participants in criminal proceedings. Characterization of international legal acts and comparative and legal analysis of the provisions of the CPC of 1960 and 2012 concerning the investigated institute are carried out. The author, on the basis of documents developed by the international community, concludes that convergence of national legislation with these standards is natural and necessary. The necessity of systematization and comprehension by scientists and practitioners of the available factual and scientific material on the specified issues is substantiated. The gaps in legislative regulation and priority directions of the institute under investigation are determined. Thus, in Ukraine, the state protection of participants in the criminal process takes its countdown from the last decade of the last century. Nevertheless, the important aspects of the institute under study are currently not resolved, and are therefore at a stage of further development. Its effective implementation is hampered by the lack of a clear procedure for ensuring security and contradictions that arise between separate rules of law, and sometimes morals. In many countries of the world community, the task of state protection of those who promote justice is successfully implemented by special state bodies whose multiplicity of functions is coordinated by a single center. Creation in Ukraine of a single coordination center of state protection of the participants in the criminal process will properly contribute to solving problems related to the institutional and functional fragmentation of law enforcement agencies, departmental differences and unjustified delays in taking appropriate security measures. International legal acts in their totality represent, on the one hand, the legal basis for the application of pre-trial investigation and court of the rules of international law in order to protect the rights and freedoms of man and citizen, and on the other, proclaim the need to develop and introduce specific legislative provisions for the provision and resolution outlined issues of criminal justice of Ukraine. Taking into account the positive foreign experience, it is expedient to further improve the investigated institute, in particular, by supplementing the provisions of the CPC of Ukraine with a separate chapter «Ensuring the safety of participants in criminal proceedings».en
dc.description.abstractВ статье рассматриваются отдельные вопросы обеспечения защиты участников уголовного производства. Осуществлено характеристику международно-правовых актов и сравнительно-правовой анализ положений УПК Украины 1960 и в 2012 гг., касающиеся исследуемого института. Автор на основании разработанных международным сообществом документов приходит к выводу, что сближение национального законодательства с этими стандартами является естественным и необходимым. Обосновывается необходимость систематизации и осмысления учеными и практиками имеющегося фактического и научного материала из обозначенных вопросов. Определяются пробелы законодательного регулирования и приоритетные направления исследуемого института.ru
