Анотація
Висвітлено специфіку планування розслідування суспільно небезпечних діянь, учинених особами з психічними захворюваннями або тимчасовими розладами психіки. Розглянуто тактичні особливості проведення допиту
залежно від ситуації розслідування та процесуального статусу особи.
In order to raise the effectiveness of investigating socially dangerous acts, committed by persons with mental illnesses or temporary mental disorders it is important to take into account the peculiarities of the planning stage in this types of cases, typical investigation situations, malingering or defensiveness of people with mental disorders as well as tactical and psychological peculiarities of conducting certain investigation acts. In criminal proceedings of this type of crimes an important role is played by interrogations of the injured parties, witnesses, who may be the suspect’s relatives, colleagues, acquaintances. The choice of the interrogation tactics is conditioned by a number of factors with one of the most important factor – the position the interrogated person has taken (the interrogation situation). In the interrogation as part of investigating this type of crimes, it is of primary importance to pay attention to the preparatory stage with the thorough research and analysis of the acquired information regarding the character of the person being interrogated (witnesses’ testimony, medical records, etc.), the use of special knowledge (study of specialized publications, consulting informed persons, involving a psychiatrist as an expert during interrogation).
Освещена специфика планирования расследования общественно опасных деяний, совершенных лицами с психическими заболеваниями или временными расстройствами психики. Рассмотрены тактические особенности проведения допроса в зависимости от ситуации расследования и процессуального статуса лица.
