dc.description.abstractДосліджено місце припинення існування об’єкта лісокористування серед правового регулювання правоприпиняючих фактів права користування лісами. Окремо акцентовано на питанні розмежування постійного та тимчасового лісокористування за підставами їх припинення. Окреслено певні прогалини у правовому регулюванні підстав припинення права лісокористування внаслідок припинення існування об’єкта цього права. Зроблено висновок, що доцільно закріпити в Лісовому кодексі України припинення права використання лісових ресурсів на території, безпосередньо пов’язаній із постраждалою земельною ділянкою, природні ресурси якої зазнали істотного пошкодження.uk_UA.UTF8
dc.description.abstractThe relevance of the article is due to the fact that the permanent reduction of forests requires to strengthen measures of restoration and protection of forest resources, especially in the conditions of terminating the existence of the object of the right to use forest resources. The article’s objective is to highlight certain issues of delimitation of permanent and temporary forest usage on the grounds of their termination, as well as outlining some gaps in the legal regulation of the grounds for termination of the right on forest usage as a result of terminating the existence of the object of this right and searching the ways of legal provision to facilitate the restoration of forest resources. The author has emphasized on the essential difference between permanent and temporary forest usage. Characteristics of both permanent and temporary forest usage defined in the legal literature as common for such a distinction have been analyzed. It has been concluded that the stated classification criteria are obviously not exhaustive, because the features of the termination of permanent and temporary forest usage have not been considered. The permanent forest usage is directly related to the land forest plot and the loss of the right to use it at the same time, is the ground for terminating the permanent forest usage. However, the termination of the right on land forest plot is not the reason to terminate temporary forest usage. It is appropriate to consolidate the termination of the right to use forest resources on the territory directly related to the affected land plot, natural resources of which have suffered a significant damage.en
dc.description.abstractИсследовано место прекращения существования объекта лесопользования в правовом регулировании правопрекращающих фактов права пользования лесами. Отдельно акцентировано внимание на вопросе разграничения постоянного и временного лесопользования по основаниям их прекращения. Очерчены определённые пробелы в правовом регулировании оснований прекращения права лесопользования по причине исчезновения объекта этого права. Сделан вывод, что целесообразно закрепить в Лесном кодексе Украины прекращение права использования лесных ресурсов на территории, непосредственно связанной с пострадавшим земельным участком, природные ресурсы которого испытали существенное повреждение.ru
