Анотація
Статтю присвячено аналізу сутності окремих елементів механізму вчинення
шахрайств. Розкрито погляд на особливість предмета сучасних шахрайств, а
також представлено позицію щодо визначення форм учинення цих злочинів.
Наголошено на розширенні погляду щодо кола об’єктів власності, які
виступають предметом сучасних злочинних посягань.
In the presented scientific article position opens up in relation to the features of mechanism of fiancée of thefts with the use of deception. Actuality of theme is conditioned by that thefts with the use of deception are characterized by the high level of latentness and complication of proving. The worker of police must be maximally well-informed about the possible charts of actions of swindlers. A public prosecutor, investigator, must plan investigation from the calculation of features of composition of these crimes. Problems that arise up for an investigator at investigation of thefts with the use of deception are analysed in the presented article. The ways of decision of these problems are enumerated. A row over of arguments is brought in relation to the revision of concept "the article" of crimes against property. Position of author is grounded about bringing of new category of property - virtual property of users of networks the Internet of resources. For a modern man new property he owns that and bosses in virtual space appeared in the use. To such objects internal playing objects behave is a technique with the special functions, personages with the special possibilities, equipment and other great deal. Such games can come forward an example, as Worlds of Warcraft, World of Tanks, in that users officially not only buy virtual things, and and actively resell them and pass on an inheritance. The cost of such objects can arrive at a few thousand Euro. In opinion of many experts of sphere of jurisprudence must property objects be confessed also accounts of games, pages of users social the internet of networks, e-mail, record library of iTunes boxes, web-site-blog. The appeals of citizens are in the whole world fixed in the judicial order with lawsuits about confession of rights for an owner after the indicated objects. There are precedents of bringing in to responsibility for the theft of virtual property. For this reason in the article position opens up in relation to that the article of thefts can be virtual property. Requirements to him : а) property is created by a man or purchased for money; b) property has a price; c) property it is possible to use and boss in virtual space; d) estimation of property gives an opportunity to define his market value. In the article maintenance of forms of feasance of thefts is also examined with the use of deception.
