dc.description.abstractРозглянуто особливості правового регулювання статусу неповнолітніх учасників кримінального провадження під час перевірки повідомлень про кримінальні правопорушення з метою забезпечення реалізації їх процесуальних прав. Актуальність указаного питання обумовлена недостатнім законодавчим регулюванням інституту допустимості доказів та неоднозначним підходом до цієї проблеми в науці кримінального процесу. Сформульовано й обґрунтовано пропозиції щодо вдосконалення процесуальних норм, які стосуються предмета дослідження.uk_UA.UTF8
dc.description.abstractThe relevance of the studies of procedural features of the beginning of pre-trial investigation within criminal proceedings concerning minors is due to the establishment of juvenile justice system in Ukraine. The objective if the article is a study of the issues on guaranteeing the rights of minors during criminal proceedings against minors in the process of realization of verifying actions on information indicating the presence of the elements of a criminal offense. It has been noted that the current norms of the Criminal Procedural Code of Ukraine do not provide procedural features of the beginning of criminal proceedings against minors. The author of the article has determined the structure of procedural activities at the specified stage of the proceedings, which is constituted by the overall sequence of separate, but related procedural acts united by a common purpose. It has been emphasized that, having the grounds it is necessary to indicate at the beginning of pre-trial investigation the commission of a criminal offense by a minor. It has been confirmed that the practice of obtaining explanations is the most spread among the investigators of the National Police in order to prevent violations of the criminal procedural legislation until the information is put into the Unified Register of pre-trial investigations. The author has offered to involve teachers and legal representatives of minors into criminal procedural activities during the verification of information on criminal offenses. It has been concluded that the main mean of ensuring the rights of minors in criminal proceedings is the timely detection of the fact that a criminal offense was committed by a minor, and timely implementation on this basis of the secured regime under the law for such individuals that would contribute to the protection of rights and interests and, accordingly, would not violate the usual way of life of a minor.en

Актуальность указанного вопроса обусловлена недостаточным законодательным регулированием института допустимости доказательств и неоднозначным подходом к этой проблеме в науке уголовного процесса.
