dc.description.abstractThis article is focused on the analysis of legislative factors that influence the mechanism of combating drug crime. The author has considered the most problematic aspects of legal regulation and suggested their solutions. The problem of combating drug crime is one of the most pressing social and legal problems in Ukraine at the beginning of the XXI century. Indeed, it is a threat to the gene pool of the nation and the national security of Ukraine. Factors that determine the particular urgency of combating drug crime in relation to life conditions in modern Ukraine are: judicial reform in the country that has been intensified over the past two years; administrative and management reform, one of the results of which was the reform of law enforcement agencies combating drug crime, optimizing their activities at all levels; polysubjectivity of the sphere of combating drug crime and versatility of its tasks. Many unsettled legal issues of functioning of the system of combating drug crime, an urgent need for the formation of an effective model of coordination of actions of law enforcement agencies and other authorities involved in this case; the lack of monographs, research and a single scientific view on the issue – all this made the topic of this article relevant both in scientific and in practical terms. Based on the conducted analysis the author has stated: first, the state criminal policy of combating drug crime should fully meet modern realities. All changes made to the criminal law must be criminologically grounded, carefully considered, detected and the tendencies of drug crime, its structure, new types, criminals, etc. predicted. Second, the reform of criminology and criminal law should be based on clear understanding of the fact what kind of changes in the state, structure and dynamics of crime can be achieved by improving the relevant institutions and norms. In this regard, the obvious fact is that now there is an urgent need for adopting the basic document about the basis of the state policy in combating crime. And this is the third. The whole legislation is related to the fight against crime, which means that a single system should be subjected to comprehensive criminological examination (based on the experience of its practical application and evaluation of the efficiency). The results of the examination should be considered while making the above mentioned Basics of the state policy by the legislator. Ukrainian society needs a single concept, the only strategy to combat crime.en
