Анотація
Зроблено спробу дослідити стан наукової розробленості питання негласного обстеження житла особи підрозділами кримінальної поліції. Проаналізовано наукові праці з різних галузей
юридичної науки, в яких вивчалося питання негласного обстеження житла особи підрозділами кримінальної поліції, зокрема в межах дослідження негласного оперативного огляду. Визначено напрямки, які потребують поглибленого дослідження.
An attempt to study the state of scientific research of the issue of secret search of person’s housing by criminal police units has been accomplished. The author has analyzed the works of Soviet scholars and stated that during the Soviet era secret search of person’s housing under the laws was permitted to hold only as an operative and search measure or method, so most of scholars researched the issue only in the context of studying organization and tactics of a secret operative search. As a result, nowadays the relevant are just provisions focused on the tactics of conducting secret operative search. The author has analyzed scientific works of contemporary scholars devoted to the secret search of person’s housing and has concluded that they are mostly devoted to studying various aspects of legal, organizational and tactical principles of carrying out secret search of person’s housing as a kind of secret investigative (search) action or operative and search measure (operative and technical measure). Due to the stated scientific works of contemporary scholars are conventionally classified into two groups: the first group includes the works written before the adoption of the Criminal Procedural Code of Ukraine of 2012, and the second – those written after the entry into force of the stated legal act. Based on the conducted research it has been stated that nowadays quite a lot of research has been accomplished, which to some extent devoted to studying various aspects of the secret search of person’s housing, but mostly they either study mentioned issue in terms of the secret operative search or define only general organizational and legal principles of implementing the studied type of the secret investigative (search) actions and operative and search measures (operative and technical measures). At the same time it has been determined that t present time there are no thorough studies devoted to the issue of the secret search of publicly inaccessible places, including person’s housing; and it has been summarized that there is an urgent need to conduct a thorough study of the issue of secret search of person’s housing.
Сделана попытка исследовать состояние научной разработанности вопроса негласного обследования жилья лица подразделениями криминальной полиции. Проанализированы научные работы из различных сфер юридической науки, в которых изучался вопрос негласного обследования жилья лица подразделениями криминальной полиции, в частности в рамках исследования негласного оперативного осмотра. Определены направления, которые требуют углублённого исследования.
