Анотація
Проаналізована сутність культурних факторів оцінки
політичних злочинів у міжнародному вимірі. Встановлено, що геополітичні конфронтації є одним із проявів
конфлікту культур та цивілізацій. Тому в контексті
міжнародного виміру культурний фактор проявляє себе
як кримінологічно значущий при нехтуванні, зневажанні
культурної багатоманітності народів світу на засадах
домінування якогось з них. Доводиться, що культурна
дискримінація – одна з найнебезпечніших її форм, яка
тягне за собою поширення практики політико-кримінальних інтервенцій.
The essence of cultural factors of assessments of political crimes within international terms. It has been found out that Cultural factors of assessment of political crimes within international terms – is a group of fundamental factors of social genesis that reflects its most deep foundations in international politics, defines scenarios of social systems development and, ultimately, humanity in the whole. Geopolitical confrontations are one of the manifestations of the conflict of cultures and civilizations. Therefore, in the context of international dimension the assessments of political offenses, cultural factor reflects itself as criminologically significant while neglecting, violating cultural diversity of the peoples of the world based on the dominance of any one of them. It is proved that in cases of external interference into internal affairs of states destructiveness of such influence is determined by two major factors: 1) an inadequate assessment of internal political practices to determine them as criminal and unacceptable for the population of the country. In this respect, we are talking about cultural discrimination – a form of political and criminal violence; 2) conflict, inconsistence of external political imported innovations with internal political traditions, customs and indigenous culture in general in its broadest sense. International dimension as in terms of formation of intergovernmental recognition of crime of political practices also provides consideration of the worldview coordinate system of the relevant society, population of the country. It is emphasized that today there is an urgent problem of reducing the degree of relativism of assessments of political crimes in international terms and at the same time reducing criminogenic potential of humanitarian and related to them interventions. This task requires the adoption of versatile, multilevel actions, subordinated to the unified conceptual vector. It is in reduction of the role of political factors of assessment of international and domestic crimes by expanding and detailed legal regulatory mechanisms based on common policies of guaranteeing and taking into account cultural diversity. It is cultural determinism has to become methodological basis for narrowing enforcement politically deterministic discretion through the improvement of legal basis to respond to political crimes from the international community. Special attention is paid to the fact that norming the activities of international actors (including international organizations, military and political coalitions) on the usage of any force to carry out any interventions has not to remain at the level of declarations of intentions, and must acquire the features of robust mechanism of legal regulation. The last among others should include branched instruments of international responsibility of the states that are synchronized at the level of various political and regional entities and subordinated to a single supranational authority of jurisdiction.
Проанализирована сущность культурных факторов оценок политических преступлений в международном измерении. Установлено, что геополитические конфронтации являются одним из проявлений конфликта культур и цивилизаций. Поэтому в контексте международного измерения оценки политических преступлений культурный фактор проявляет себя как криминологически значимый в случае пренебрежения, попирания культурного многообразия народов мира на основе доминантности какогонибудь из них. Доказывается, что культурная дискриминация – одна из самых опасных её форм, которая влечёт за собой распространение практики политико-криминальных интервенций.
