Анотація
У статті проаналізовано підстави та особливості цивільно-правової, дисциплінарної,
адміністративної та кримінальної відповідальності працівників і військовослужбовців Національної
гвардії України. Автором сформульовані визначення, підстави, особливості загальної і спеціальної
цивільно-правової та дисциплінарної відповідальності особового складу Національної гвардії України.
Досліджені підстави притягнення до дисциплінарної відповідальності військовослужбовців Національної
гвардії за вчинення адміністративних проступків, а також особливості призначення їм кримінальних
покарань за вчинення військових злочинів.
The paper analyzes grounds and features of civil, disciplinary, administrative and criminal liability of employees and soldiers of the National Guard of Ukraine. The author formulated the definition, grounds and features of general and specific civil and disciplinary liability of the National Guard of Ukraine personnel. Grounds for holding soldiers of the National Guard liable for the administrative offences, as well as for the imposition of criminal penalties for the war crimes are explored. Relevance of the topic is that the state shall ensure the protection and unconditional implementation of the legal provisions therefore important means of ensuring the security function of the law is a legal responsibility. The latter is a qualitative indicator of actual implementation of the rights and freedoms of the individual in the social reality. This is due to the fact that in the process of implementation of legal liability is a direct influence of the state in the sphere of regulatory enshrined subjective rights and legal responsibilities. This identifies value systems of the state, the level of civilization of a society, the spiritual and cultural level of the population, and the availability of legal guarantees and protection mechanisms for human rights and freedoms. In this respect, the issue of legal liability of law enforcement officers, including the National Guard of Ukraine, are of particular relevance. This is primarily due to the fact that the legal status of workers and soldiers of the National Guard can not be considered separately from their legal liability because they are acting on behalf of the State, in its interests, and, of course, should be responsible for the poor performance of their duties' ties. In addition, these persons have the right to apply the duty physical force, special means, firearms, again, can lead to injury or even death of a person, which entails responsibility under the law.
В статье проанализированы основания и особенности гражданско-правовой, дисциплинарной, административной и уголовной ответственности работников и военнослужащих Национальной гвардии Украины. Автором сформулированы определения, основания, особенности общей и специальной гражданско-правовой и дисциплинарной ответственности личного состава Национальной гвардии Украины. Исследованы основания привлечения к дисциплинарной ответственности военнослужащих Национальной гвардии за совершение административных проступков, а также особенности назначения им уголовных наказаний за совершение военных преступлений.
