Анотація
В даній науковій статті розглядається актуальне питання юридичної літератури а саме
сьогодення кодифікації адміністративно-деліктного права України. Також зроблені ґрунтовні та
актуальні висновки які полягають в тому, що питання реформування адміністративного, в тому числі і
його складової адміністративно-деліктного законодавства, розробка і прийняття нового кодифікованого
адміністративно-деліктного нормативно-правового акта, який би відповідав сучасним вимогам правової,
соціальної, демократичної держави є дуже актуальними, і складають один з пріоритетних напрямків
реформи, здійснюваної в Україні.
In this scientific article the current legal literature and is present codification of administrative and tort law Ukraine. Actuality is that the article is devoted to the main approaches to the formation of the definition of "codification". The analysis of the relationship between the concepts "codification" of other types of systematization of legislation. The basic directions of further development of codification of administrative and tort law in Ukraine. The paper indicated that the conceptual source of administrative responsibility the Constitution of Ukraine, but specific rules governing the administrative liability contained in the Code of Ukraine on Administrative Offences (hereinafter - the CAO), which was adopted in the 80s of last century. He occupies a central place in the law of Ukraine on Administrative Offenses. Attention is paid to the current state in which Ukrainian society is experiencing a characteristic change in the awareness of rights and freedoms. Keywords: codification, incorporation, consolidation, harmonization of legislation, administrative and tort legislation codification of administrative and tort legislation of Ukraine. Creating a completely new legal framework could be momentary, as in many areas of public relations for a long time and have had to use the old regulations, adapting them to new conditions. However, this situation can not last indefinitely. At a certain stage of social development is necessary to rethink the conceptual bases of legal regulation of certain social relations in view of the present, bringing them into line with the pressing needs of society. Is no exception and administrative tort relations, regulatory model which is a institution of administrative responsibility. On the one hand, the development of this institution is still on the principles embodied in the Soviet period, taking into account relevant ideology, on the other - there it spread to a relationship that simply did not exist and could not exist at the time. The article is to determine the etymological meaning of "codification" analysis of its correlation with other types of systematization of legislation and identify key areas for further development of codification of administrative and tort law in Ukraine. Аlso made fundamental and relevant conclusions that lies in the fact that the issue of administrative reform, including its administrative component of tort law, development and adoption of new administrative tort codified legal act that would meet modern requirements of legal, social, democratic the state is very relevant, and constitute one of the priorities of the reforms carried out in Ukraine.
В данной научной статье рассматривается актуальный вопрос юридической литературы а самое настоящее кодификации административно-деликтного права Украины. Также сделаны основательные и актуальные выводы которые заключаются в том, что вопросы реформирования административного, в том числе и его составляющей административно-деликтного законодательства, разработка и принятие нового кодифицированного административно-деликтного нормативно-правового акта, который бы отвечал современным требованиям правового, социального, демократического государства являются очень актуальными, и составляют одно из приоритетных направлений реформы, осуществляемой в Украине.
