Анотація
Проаналізовано історію становлення, розвиток і правовий стан підрозділів Національної
гвардії України у період 1991–2000 років та на сучасному етапі. На підставі порівняльноправового аналізу автором виділено основні особливості правового регулювання діяльності
сил Національної гвардії України та запропоновано зміни до чинного законодавства України, яке регулює її діяльність.
The objective of the article is a comparative analysis of the legal status of the National Guard of Ukraine formed in 2014 with the legal status of the unit, which existed until 2000. This will make possible to analyze possible errors within normative and legal provision in the activity of this state authority agency, structure, powers and to offer amendments to the existing legislation of Ukraine that regulate its activity. The history of formation, development and legal status of the National Guard units in Ukraine during 1991–2000 and at the present stage is analyzed. It is emphasized that the creation of the National Guard in 2014 was caused by the danger to the territorial integrity of Ukraine, threats to its national sovereignty, provocation of power scenario and the destabilization of the situation in the country. The state urgently needed a body with law enforcement functions, which at the same is able to perform the service and combat missions, both in peacetime and in terms of implementation of the legal regime of emergency and/or war state. Based on comparative and legal analysis the author singled out the main features of legal regulation of the National Guard Forces of Ukraine. The conclusions about the main differences of legal status, tasks and organizational structure of the National Guard of Ukraine of 2014 from liquidated units of the National Guard existing during 1991–2000 are made. Amendments to the current legislation of Ukraine regulating the activity of the National Guard of Ukraine are offered. The practical significance of the paper is the fact that considering defined theoretical positions it is possible to develop specific recommendations to improve the current legislation, which in case of their implementation let to increase the efficiency of the activity of the National Guard of Ukraine in the sphere of realizing the law enforcement functions of the state.
Проанализирована история становления, развитие и правовое положение подразделений Национальной гвардии Украины в период 1991–2000 годов и на современном этапе.
