Анотація
Досліджено наукові підходи до розуміння інтуїції та доцільності використання інтуїтивного знання у професійній діяльності. Систематизовано переваги використання правової інтуїції в роботі органів внутрішніх справ та суду. Зроблено висновок, що правова інтуїція є важливою складовою професійної правосвідомості, вона є проявом професійної кмітливості та гнучкості мислення осіб, які застосовують право.
The object of the study is legal awareness. The subject of the research is legal intuition as an element of professional legal awareness. The article’s objective is to reveal the nature of legal intuition as part of professional legal awareness; to establish the role and place of intuitive knowledge in legal enforcement activities (by the example of the activity ofinvestigation and court employees). The need for achieving the objective of the study has led to the use of formal and logical, systematic, critical and comparative and legal methods of cognition. The relevance of the topic is the fact that in terms of rejecting the positivist dogma there is an objective need for theoretical and legal research of legal intuition as a hidden but important element of legal awareness. Scientific approaches to understanding intuition and the feasibility of using intuitive knowledge in professional activities are studied in the article. Advantages of using legal intuition in the work of internal affairs agencies and courts are systematized. It is proved that the emergence of intuitive knowledge is related to the results of previous work, professional and life experience of the subject of legal enforcement. It is concluded that the legal intuition is an important part of professional legal awareness, it is a manifestation of the professional intelligence and flexibility of people thinking who apply the law. The practical significance of the work lies in the fact that grounded positions and conclusions deepen scientific knowledge about the phenomenon of legal awareness in general and legal intuition as its integral component. Obtained results can be used in teaching the theory of state and law and to solve practical problems related to the application process of the law norms.
Исследованы научные подходы к пониманию интуиции и целесообразности использования интуитивного знания в профессиональной деятельности. Систематизированы преимущества использования правовой интуиции в работе органов внутренних дел и суда. Сделан вывод, что правовая интуиция является важной составляющей профессионального правосознания, она является проявлением профессиональной смекалки и гибкости мышления лиц, применяющих право.
