Анотація
Проведено теоретико-правове дослідження поняття «адміністративно-правовий механізм забезпечення виборчих прав громадян в Україні». На підставі аналізу наукових праць у галузі
теорії держави та права, конституційного права й адміністративного права визначено поняття
та виділено структурні елементи адміністративно-правового механізму забезпечення виборчих прав громадян в Україні, його особливості та відмінність від механізму адміністративно-правового регулювання виборчих прав.
It has been concluded that there is a certain mechanism for guaranteeing the electoral rights of citizens by administrative and legal means, that is, administrative and legal mechanism. In this regard, the objective of the article is to determine the essence and analysis of the structure of administrative and legal mechanism for ensuring the electoral rights of citizens in Ukraine. The author has conducted theoretical and legal study of the concept of “administrative and legal mechanism of guaranteeing the electoral rights of citizens in Ukraine”. It has been determined that administrative and legal mechanism of guaranteeing citizens’ electoral rights is a part of the general legal mechanism of ensuring the rights and freedoms of citizens in Ukraine and represents a certain system of related elements. These elements according to the structural nature can be defined as an object, subjects, content and auxiliary elements. It has been emphasized that administrative and legal nature of this mechanism affects the legal status and the range of subjects of guaranteeing the electoral rights of citizens. Such subjects are, first of all, executive agencies and other agencies of the state having the external management functions, as well as state agencies, which have the right to apply the measures of administrative coercion. The author has suggested to include the principles of guaranteeing the electoral rights of citizens, administrative and legal norms, administrative and legal relations, legal guarantees, administrative and legal forms and methods of ensuring the electoral rights and methods of administrative and legal regulation into the content of the mechanism of administrative and legal guaranteeing of the electoral rights of citizens. Based on the analysis of scientific works in the field of the theory of state and law, constitutional law and administrative law, the author has determined the notion and has distinguished the structural elements of administrative and legal mechanism of guaranteeing the electoral rights of citizens in Ukraine, its features and the distinction from the mechanism of administrative and legal regulation of the electoral rights.
