Анотація
Дисертація присвячена розробленню основ методики
розслідування посягань на життя та здоров’я журналістів. Досліджено
елементний склад криміналістичної характеристики названих
злочинів, організацію їх розслідування, зокрема особливості виявлення
ознак кримінального правопорушення та початку досудового
розслідування, обставини, що підлягають з’ясуванню, типові слідчі
ситуації та планування розслідування, організацію взаємодії під час
розслідування. Значну увагу приділено організації і тактиці
проведення окремих слідчих (розшукових) дій під час розслідування
посягань на життя та здоров’я журналістів: огляду місця події, трупу,
речей та документів, допиту, обшуку, слідчого експерименту,
пред’явлення для впізнання. Розглянуто можливості використання
судових експертиз.
The dissertation is devoted to the development of the foundations of investigation methods of infringements on life and health of journalists. This method is interspecific and includes forensic characteristics of studied crimes, provisions about the organization of investigation and specifics of the organization and tactics of selected investigative (search) actions. The elemental composition of the forensic characteristics of the named crimes is investigated: the data on the victim, typical methods and tracks of the crime, the conditions of the crime, the data on offender. A journalist, his family member or close relative may be the victim of such crimes. The most specific methods of committing attacks are blows and shocks with the help of the attacker's limbs, sticks, metal pipes, bats, as well as the use of cold weapons and/or firearms, explosives as instruments of crime. The organization of investigation of infringements on life and health of journalists is examined, including studying the features of identifying the signs of a criminal offense and initiating a pre-trial investigation, the circumstances to be identified, typical investigative situations and investigation planning, as well as the organization of cooperation during the investigation. For the initial stage of the investigation, the following typical investigative situations are inherent: 1 ) the offense was committed in conditions of obviousness, the signs of the person who committed the crime are established; 2) the offense was committed in conditions of nonobviousness, the signs of the person who committed the crime were not established. The main directions of cooperation during the investigation of infringements on life and health of journalists are the interaction of investigator with the operational staff units, specialists and experts, and the media, journalistic organizations and the public. Significant attention is paid to the organization and tactics of selected investigative (search) actions during the investigation of infringements on the life and health of journalists. The inspection of the scene, corpse, things and documents (including electronic ones) is considered among the most informative investigative (search) actions. The tactics of interrogation during investigating infringements on life and health of journalists has its own specificity, which is manifested in the subject, the specifics of preparation and conducting. The conducting of search, investigative experiment, presentation for identification is also inherent in such criminal proceedings. Forensic medical, authorship and handwriting examinations, as well as forensic examination of computer equipment and software products are typical for investigation of infringements on life and health of journalists. The tools of professional journalistic activity and items containing traces of a criminal act are usually sent for the forensic examination.
