Анотація
Досліджено питання адміністративної відповідальності за правопорушення, передбачене
ст. 160 Кодексу України про адміністративні правопорушення «Торгівля з рук у невстановлених місцях». Акцентовано увагу на недосконалості норм цієї статті та запропоновано шляхи
поліпшення регулювання розглянутих відносин за допомогою внесення змін у Кодексу.
The issue of administrative liability for the offence under the Art. 160 of the Code of Ukraine on Administrative Offences «Trade with hands in prohibited places» is researched. It is noted that nowadays there is an ongoing reform of administrative law, hence the need for analyzing the administrative liability for violations in trading activities. The danger of illegal trade to the society, the need of state authorities to focus on combating this offence is emphasized. It is noted that for the detection, prevention and suppression of offences in the area of trade there are many specialized institutions in the country. Special attention is paid to the fact that the police in this case should be given a secondary, supporting role. The author comes from a position that successful prevention and combating spontaneous trade is possible by the joint work of the police and other competent services. Accordingly, the author has offered to review authorities in executing administrative protocols for trade with hands in prohibited places, by putting such authorities (by amending the Article 255 of the Code of Ukraine on Administrative Offences), besides the officials of internal affairs agencies, on authorized officials of the State Service of Ukraine on Safety Food and Consumer Protection. The author has also suggested to increase the fine for committing this offence.
Исследован вопрос административной ответственности за правонарушение, предусмотренное ст. 160 Кодекса Украины об административных правонарушениях «Торговля с рук в неустановленных местах». Акцентировано внимание на несовершенстве норм данной статьи и предложены пути улучшения регулирования рассматриваемых отношений посредством внесения изменений в Кодекс.
