Анотація
Визначено зміст і особливості дисциплінарних проваджень Національної поліції України. На основі аналізу наукових
досліджень визначено поняття дисциплінарного провадження в органах поліції. Охарактеризована процедура залучення поліцейських до дисциплінарної відповідальності. З’ясовано недоліки чинного законодавства, що регулює дисциплінарні провадження по відношенню до поліцейських, і надані обґрунтовані пропозиції щодо їх усунення.
The contents and peculiarities of disciplinary proceedings in the National Police of Ukraine are determined. On the basis of the analysis of scientific opinions, the notion of disciplinary proceedings in the police authorities is defined, which suggests the activity of their authorized officials for the consideration and solving of individually specific cases concerning the commission of subordinate employees of a disciplinary offense and bringing them to disciplinary responsibility, as well as the establishment and elimination of the causes, which is regulated by the legislation. and the conditions that contributed to the commission of such an offense. The procedure of bringing the police to disciplinary responsibility is described. The shortcomings of the current legislation regulating disciplinary proceedings against the police have been clarified and justified proposals for their removal. It has been established that to date, the legislation on disciplinary liability of police officers and the implementation of disciplinary proceedings against them needs to be reviewed and systematized, taking into account the legal status of the police. It is substantiated that in order to strengthen the official discipline in the bodies of the National Police, the proper legal regulation of the procedures for bringing the police to disciplinary responsibility, it is necessary to adopt the Law of Ukraine «On the disciplinary statute of the National Police of Ukraine» as soon as possible, in which to consolidate the list of acts that are recognized as disciplinary offenses and penalties, the circumstances that apply to their execution, circumstances that mitigate or impose a disciplinary responsibility, officials authorized to impose them, cue procedure for exercising disciplinary proceedings against police officers and their terms, the powers of its participants, documenting requirements, the order of disciplinary action.
Определено содержание и особенности дисциплинарных производств в Национальной полиции Украины. На основе анализа научных исследований определено понятие дисциплинарного производства в органах полиции. Охарактеризована процедура привлечения полицейских к дисциплинарной ответственности. Выяснено недостатки действующего законодательства, регулирующего дисциплинарные производства в отношении полицейских, и предоставлены обоснованные предложения по их устранению.
