Анотація
Аналізується фахова юридична література та думки вчених щодо висвітлення правового регулювання оперативно-
розшукової протидії різним видам злочинності, які розподіляються за безпосереднім предметом регулювання на 3
групи. Класифікуються правовідносини, які виникають в процесі оперативно-розшукової протидії незаконному обігу
зброї та суб’єктів вказаних правовідносин.
In the article the author analyzed the specialized legal literature and the opinions of scientists on the coverage of the legal regulation of operational-search counteraction to various types of crime, which divided into three groups. However, the author pointed out that when considering the legal regulation of any process of combating crime, one should not only study legal relations, regulations or subjects of such activity, but to investigate them in a complex. Regarding the legal relationship that arises in the process of operational-search counteraction to the illicit circulation of weapons, the author divided them into 4 groups: the legal relationship that arises between an authorized operationalsearch legislation subject with other actors of the National Police in the process of operational-search activities and pretrial investigation; legal relations that arise with the subject of the authorized operational-search legislation in the process of interaction with the bodies of state executive power, private organizations and enterprises, the population; legal relations that arise with the operative-search legislation by a subject with specific persons or groups of persons who have fallen into the field of view of law-enforcement bodies in connection with the preparation or committing of crimes related to the illicit trafficking of weapons; legal relationships that arise between an agent authorized by the operative and investigative legislation in the course of monitoring the observance of the lawfulness of his activities, the prosecutor's office and the court. Also, the study identified the subjects of these legal relationships, in particular: state bodies and institutions; natural persons having weapons on legal grounds; actors possessing weapons in connection with the exercise of their functions; persons who fell into the sight of law enforcement agencies in connection with involvement in the illicit arms trafficking; subjects of law-enforcement activity, which impose a duty to prevent the entry and possession of weapons in the illicit circulation; entities subject to control over the legal circulation of weapons and licensing functions; actors that oversee and enforce law enforcement authorities.
Анализируется профессиональная юридическая литература и мнения ученых по освещению правового регулирования оперативно-розыскного противодействия различным видам преступности, которые распределяются по конкретным предметам регулирования на 3 группы. Классифицируются правоотношения, возникающие в процессе оперативно- розыскного противодействия незаконному обороту оружия и субъектов указанных правоотношений.
