Анотація
На основі існуючих доктринальних понять громадського контролю й аналізу чинного законодавства сформульовано авторське визначення громадського
контролю за діяльністю Національного антикорупційного бюро України з урахуванням її специфіки та особливостей. Окрему увагу приділено характеристиці
предмета та суб’єктного складу громадського контролю за діяльністю Національного антикорупційного бюро України.
The author has formulated own definition of public control over the activities of the National Anti-Corruption Bureau of Ukraine (NABU) on the basis of existing doctrinal concepts of public control and analysis of the current legislation, taking into account the specifics and features of the latter. Particular attention has been paid to the characteristics of the object and the subject composition of public control over the activities of the National Anti-Corruption Bureau of Ukraine. It has been established that according to the organizational and legal form, the public control over the activities of the NABU is an external control, that is implemented in the absence of organizational subordination within relations between the controlling subject and object, to which it is carried out. Such a control is carried out both individually (by individual citizens) and collegially (by the Public Control Council), where not only the object of control, but also the rights of controlling subjects in relation to its implementation depends on this. It has been noted that the specifics of public control over the activities of the NABU is that the latter is carried out by general subjects (individual citizens and public associations, other civil society institutions) and special subjects (in particular, by the Public Control Council of the NABU). In turn, the composition of subjects that implement the public control over the activities of the NABU, defines the content of the exercised rights: 1) general – which follows from the provisions of the laws of Ukraine “On Citizens’ Appeals”, “On Democratic Civilian Control over the Military Organization and Law Enforcement Agencies of the State”, “On Citizens Associations”, and 2) special, which are stipulated by the Law of Ukraine “On the National Anti-Corruption Bureau of Ukraine”.
На основе существующих доктринальных понятий общественного контроля и анализа действующего законодательства сформулировано авторское определение общественного контроля за деятельностью Национального антикоррупционного бюро Украины с учётом её специфики и особенностей. Отдельное внимание уделено характеристике предмета и субъектного состава общественного контроля за деятельностью Национального антикоррупционного бюро Украины.
