Анотація
В статті автором розглядаються методи, що використовуються при провадженні судової телекомунікаційної експертизи. За основу взято класифікацію методів яка містить три класи: загальнонаукові методи, окремонаукові методи і спеціальні методи. Детально розглянуто всі три класи. Надана рекомендація при проведенні судових телекомунікаційних експертиз використовувати методи запозичені з інших видів експертиз, які пройшли апробацію часом. Найбільш підходящими для використання визначені методи і методики, що використовуються при проведенні судових комп’ютерно–технічних експертиз.
In this article the author examines the methods used in the conduction of the forensic telecommunications examination which is one of a new kind of the forensic examinations. The classification of methods, which includes three classes such as general scientific methods, private scientific methods and special methods taken as the basis. All three classes are considered in details. The general scientific methods of visual investigation, observation, measurement, comparison, testing, organoleptic, classification, experiment, modeling as well as several special methods are considered in details. Up to 2006 in Ukraine the forensic computer and technical examinations were assigned to solve the problems related to the study of computer and technical means, telecommunication systems, electronic devices, programs, etc. However, the investigative and expert practice testified to the constant growth and diversity of the list of issues that were submitted for the decision of experts requiring the applied special knowledge field expansion. The logical consequence of these processes was the formation of a new kind of engineering and technical examinations named as forensic telecommunications examination. Taking into account the complex nature of the forensic telecommunications examination, it is recommended to use methods borrowed from the other types of examinations approved by time while carrying it. The methods and techniques used in conducting the forensic computer and technical examinations are determined as the most suitable for use. It is indicated that exactly they can be taken as the basis of the forensic telecommunications expertise as its own methods of investigation.
В статье автором рассматриваются методы, используемые при производстве судебной телекоммуникационной экспертизы. За основу взята классификация методов, которая содержит три класса: общенаучные методы, частнонаучные методы и специальные методы. Подробно рассмотрены все три класса. Дана рекомендация при проведении судебных телекоммуникационных экспертиз использовать методы заимствованные из других видов экспертиз, которые прошли апробацию временем. Наиболее подходящими для использования определены методы и методики, используемые при проведении судебных компьютерно-технических экспертиз.
