Анотація
У статті зроблена спроба визначити фактори, що впливають на стан оперативно-розшукової протидії в Україні. Виділені основні групи зазначених факторів, наведена їх характеристика. Доведено, що фактори, які впливають на рівень наркоконтрабанди в Україні, мають бути об'єктом постійного моніторингу та прогнозування з боку суб'єктів оперативно-розшукової протидії контрабанді наркотиків.
В статье сделана попытка определить факторы, влияющие на состояние оперативно-розыскного противодействия в Украине. Выделены основные группы указанных факторов, приведена их характеристика. Доказано, что факторы, влияющие на уровень наркоконтрабанды в Украине, должны быть объектом постоянного мониторинга и прогнозирования со стороны субъектов оперативно-розыскной противодействия контрабанде наркотиков.
The authors of the article have attempted to determine the main external and internal factors that may affect the effectiveness of conducting operative and search counteraction to drug smuggling, which affect the state of operative and search counteraction in Ukraine. The thoughts of scholars in regard to this topic have been studied. The main groups of these factors have been distinguished; their characteristics have been provided.
It has been proved that the main factors that can significantly affect the state of operative and search counteraction to drug smuggling are as follows: the level of interest to Ukraine by international drug dealers; processes occurring in the structure of transnational crime; the level of the organization and provision of the customs and border regime both on the territory of Ukraine and on the territory of neighboring countries; the presence of a corruption segment among law enforcement, controlling and other state agencies, which activities are related to the implementation of customs and border control, counteraction to drug smuggling and illicit trafficking of drugs of international origin; the level of regulatory provision of operative and search counteraction to drug smuggling; the state of the direct organization of operative and search counteraction to drug smuggling; the level of financial and material, organizational, informational, personnel, scientific and technological, methodological provision of law enforcement agencies, which are engaged in counteraction to drug smuggling and illicit drug trafficking of international origin; the effectiveness of the mechanism for the timely exchange of operative information between law enforcement officers of Ukraine and other countries; the level of tolerance to drug smugglers in Ukraine; the level of assistance to law enforcement agencies by the population in detecting and documenting drug smuggling and illicit drug trafficking of international origin in Ukraine; the degree of availability in Ukraine of drugs of international origin and information content about them, etc.
The authors have suggested to consider these factors as an element of operative and search characteristics of drug smuggling; causes and conditions assisting to the organization and commission of drug smuggling; objects of operative prevention, operative monitoring and forecasting; an element of operative situation; the subject matter of the research by the theory of operative and search activities.
The impact of the above mentioned factors on the state of operative and search counteraction to drug smuggling can be manifested in the difficult detection, recording and documentation of the features of the organization and commission of drug smuggling; the weakened capabilities of the subjects of operative and search counteraction to drug smuggling to respond drug-related threats in a timely manner.
