Анотація
У статті проаналізовано відповідальність сторін за порушення умов договору
контрактації сільськогосподарської продукції. Визначено, що відповідальність сторін за
порушення зобов’язань за договором контрактації сільськогосподарської продукції
встановлена у формі неустойки (штраф, пеня) та у формі відшкодування збитків.
Охарактеризовано правові наслідки, що наступають у випадку порушення даного
зобов’язання. Встановлено підстави звільнення від відповідальності за порушення
договору контрактації сільськогосподарської продукції.
Problem Setting. In order to provide the population with agricultural products and to form a state reserve, a well-established system of relations for the purchase of agricultural products is urgent. Taking into account the specific features of the development of agricultural production, it is necessary to define the liability of the parties for violating the terms and conditions of contracts for the delivery of agricultural products. Analysis of resent researches and publications. The problems of civil law liability were studied by legal scholars in different respects. Comprehensive research in this sphere was conducted by O.S. Ioffe, B.S. Antimonov and others. Target of research. The aim of the paper is to investigate the liability of the parties for violating the terms and conditions of contracts for the delivery of agricultural products. In order to achieve this goal, the following tasks must be solved: to carry out a legal analysis of the liability, which will occur if a producer and a purchaser violate the terms and conditions of thecontract for the delivery of agricultural products. Article’s main body. The article analyzes the liability of the parties for violating the terms and conditions of contracts for the delivery of agricultural products. It is defined that the liability of the parties for breach of obligations under the contract for the delivery of agricultural products is established in the form of a penalty (fine, penalty) and in the form of damages. The legal consequences that occur in the event of a breach of this obligation are described. The grounds for relief of liability for breach of contracts for the delivery of agricultural products have been established. Conclusions and prospects for the development. Analyzes the liability of the parties for violating the terms and conditions of contracts for the delivery of agricultural products is of great scientific and practical importance, since lack of some provisions in the legislation prevents from the possibility of proper protection of the parties rights.
