Розглянуто проблеми проходження служби в органах внутрішніх справ, виходячи із сучасних умов розвитку держави. Обґрунтовано необхідність нагального застосування нових методів відбору кандидатів на службу, а саме дослідження кандидатів на поліграфі та конкурсного порядку відбору. Досліджено проблему необґрунтованої диференціації правового
регулювання окремих аспектів проходження служби особами рядового та начальницького
складу органів внутрішніх справ, запропоновано шляхи її вирішення.
The problems of service within law enforcement agencies based on the present conditions of country’s
development are studied. The need to improve the quality of internal affairs personnel is outlined.
It is grounded that this issue should be dealed at the selection stage checking candidates on
their professionalism, loyalty, reliability, honesty and tolerance. It is suggested in the course of
such verification, to apply the candidate’s data on a polygraph. This measure will allow the head
of internal affairs unit to obtain information about the behaviour and character of the candidate; to
identify problems at the previous job, to check moral character of the candidate, the truth of the
submitted information, etc. Aiming at improving the recruitment process to the police force the author
offers to introduce a competitive selection procedure that will allow to find the best candidates
according to their professional characters.
The problem of unjustifiable differentiation of legal regulation of certain aspects of service by privates
and officers within internal affairs agencies is researched. It is proposed to set a limit of six
months probation for privates and officers within internal affairs agencies as it is provided by the
general labour legislation. It is also suggested to bring norms regulating the process of movements
and transfers within the Regulation on Service by privates and officers within internal affairs
agencies approved by the Resolution of the Cabinet of Ministers of the Ukrainian SSR dated from
July 29, 1991 № 114 to the requirements of the general labour legislation.
The provisions of the Law of Ukraine «On Lustration» dated from September 16, 2014 № 1682-VII
concerning dismissal of persons serving within internal affairs agencies and holding certain positions
at the appropriate time are studied. The necessity of consolidation of appropriate ground for
dismissal within the Regulation on Service by privates and officers within internal affairs agencies
is grounded.
Рассмотрены проблемы прохождения службы в органах внутренних дел, исходя из современных условий развития государства. Обоснована необходимость скорейшего применения
новых методов отбора кандидатов на службу, а именно исследования кандидатов на полиграфе и конкурсного порядка отбора. Исследована проблема необоснованной дифференциации правового регулирования отдельных аспектов прохождения службы лицами рядового и начальствующего состава органов внутренних дел, предложены пути её решения.
