Анотація
Здійснено функціональний аналіз запобігання різним видам злочинів, досліджено структуру
запобіжного процесу в усіх його формах, встановлено залежність елементів системи запобігання, розглянуто об’єкти та суб’єкти профілактичного процесу. Запропоновано конкретні
напрямки і форми оптимізації функціональних зв’язків через комплексне вирішення питань
забезпечення режиму законності у запобіжній діяльності, створення ефективної моделі функціонування механізму та його апробації на практиці, вдосконалення організаційно-
штатних структур суб’єктів протидії злочинності.
The functional analysis of the prevention of various crimes is conducted, the structure of warning process in all its forms is investigated, the dependence of the preventive system elements is established, objects and subjects of preventive process are considered. The content, the main directions of the system, element and component structure, characteristics and significance of some static and dynamic elements of crime prevention activity are determined. The essence of functional analysis for considering the legal phenomena is determined by comparing it with the system, the structural and mechanistic approach, modeling, etc., on the basis of which the constituent elements of mentioned mechanism are structured, namely the legal means, functions, forms and methods of influence, operating environment, means of optimizing and improving activity. Separate aspects of the current state of legal provision of crimes prevention are analyzed and directions of its perfection are determined. The practice of the enforcement mechanisms realization of crime prevention in the activities of law-enforcement agencies is characterized; particularly it’s activity of internal affairs agencies. The sphere of profile criminological functions is outlined and methods of criminological effect are systematized, the specificity of their effects on the functioning of the crime prevention mechanism is determined. Specific directions and forms of optimization of functional connections are proposed by complex decision of issues of ensuring the legitimacy procedure in the prevention activities, the creation of effective model of the functioning mechanism and its testing in practice, improving the organizational structure of the subjects of criminality counteraction. According to the results of the research the recommendations aimed at optimizing the theoretical and legal base and practical activities on crimes prevention are given.
Проведён функциональный анализ предотвращения различных видов преступлений, исследована структура предупредительного процесса во всех его формах, установлена зависимость элементов системы предотвращения, рассмотрены объекты и субъекты профилактического процесса. Предложены конкретные направления и формы оптимизации функциональных связей через комплексное решение вопросов обеспечения режима законности в профилактической деятельности, создание эффективной модели функционирования механизма и его апробации на практике, совершенствование организационно-штатных структур субъектов противодействия преступности.
