Анотація
На підставі аналізу дефініцій «база даних», «об’єкти інформаційних правовідносин» доводиться, що база даних може розглядатися як об’єкт інформаційних правовідносин. Наголошено, що розгляд бази даних у межах інформаційних правовідносин потребує удосконалення законодавства.
The relevance of the article is due to the fact that at the modern stage of society’s development the databases have become one of the demanded objects being used both by individuals, legal entities and the state through the public authorities. Databases are the subject of copyright protection that can not be doubted, but active development of information technologies leads to the fact that modern electronic databases are constantly subject to change, update. As a result, the static of protection of copyright of the object extends only to the principle ofbuilding the database. In that case, the issue of legal protection ofdatabase content, i.e. its information filling is out oflawyers’ sight. The article’s objective – is to establish the features of a database as the object of information legal relations. This objective is achieved under the consideration of the categories of «database», «objects ofinformation legal relations». According to the research, the author has offered to consider the database as a multifaceted category. It belongs to the objects of civil rights and could be considered within copyright and legal, information and legal aspects. According to the copyright and legal aspect the database – is the original system of location and search of information (data) that is listed in the database. The second aspect – is the information aspect, under which the database – is the information, data organized within the system of the database.
На основании анализа дефиниций «база данных», «объекты информационных правоотношений» доказывается, что база данных может рассматриваться как объект информационных правоотношений. Отмечено, что определение базы данных в рамках информационных правоотношений требует усовершенствования законодательства.
