Анотація
Здійснено аналіз правового статусу керівника органу досудового розслідування згідно з
новим КПК України, зокрема, специфіка його організаційних і контрольних функцій у порівнянні з КПК 1960 року.
Analysis of the legal status of the head of the pre-trial investigation agency according to the new Criminal Procedural Code of Ukraine is realized in the article. In particular, the specifics of its organizational and supervisory functions in comparison with the Criminal Procedural Code of 1960 are analyzed. Research of the nature of the legal status, its characteristics, kinds is conducted. The authors studied scientists’ point of view on conceptual apparatus of the head of the pre-trial investigation agency, its functions, which are changed in the new Criminal Procedural Code of Ukraine. Scientific researches of both Russian and Ukrainian scientists and lawyers are analyzed. Imperfection of legislative assignment of the legal status of the head of the pre-trial investigation agency to the actual amount of administrative work is established. Such an imperfection also concerns to the direct participation in timely registration of statements and reports about commitment of criminal offences in the Integrated Register of pre-trial investigations, giving qualification to offences, monitoring the timely announcement a person as a suspect, election of preventive punishment for him, control over terms of investigation, etc. Managing problems of the head of the pre-trial investigation agency are researched. These problems apparently are not related to criminal proceeding, but significantly affecting the organization of the investigative unit’s activity in effective fulfilling the main tasks of the criminal proceedings, especially personnel, social, educational work with subordinates, etc. According to the results of the research, and issues stated there some propositions on improving the current legislation and normative and legal acts, functions, rights and duties of such category of leaders are presented.
