Анотація
Метою статті є визначення завдань, які поставлені перед оперативними підрозділами Національної поліції України і які вирішуються під час застосування оперативно-розшукових заходів відомчого санкціонування, а також встановлення відмінностей між нормативно-закріпленими завданнями та тими, які фактично виконуються в процесі проведення таких заходів.
The purpose of the article is to determine the tasks that are solved during their application of operational and investigative measures of departmental authorization, in terms of tasks set before the operational units of the National Police of Ukraine, as well as to establish differences between regulatory tasks and those actually performed in the process. holding such events. It is established that each of the operational and investigative measures carried out by the decision of the head of the relevant operational unit or his deputy is aimed at performing only its inherent tasks, which do not always correspond to the regulatory tasks assigned to them. The list of tasks that are solved during the application of operational and investigative measures of departmental authorization is determined: 1) visual observation of the place or thing; 2) acquaintance with the financial and economic activities of enterprises; 3) performance of a special task on disclosure of criminal activity of an organized group or criminal organization. It is established that the statutory tasks of visual observation of a place or thing and the implementation of a special task to detect criminal activity of an organized group or criminal organization are general tasks of operational and investigative activities and can not serve as a justification for this event. In turn, the task of getting acquainted with the financial and economic activities of enterprises may be the basis for justifying the implementation of this measure, but the study showed that in the process of implementing this measure can solve a much wider range of tasks. In this regard, the normative consolidation of the tasks defined in the article is proposed. It is established that the lack of normative consolidation of tasks that can be solved during the application of operational and investigative measures of departmental authorization, may ultimately affect the effectiveness of their implementation and may lead to a situation where operational staff will not fully use the available operational capabilities of such measures.
Целью статьи является определение задач, которые поставлены перед оперативными подразделениями Национальной полиции Украины и решаемые при применении оперативно-розыскных мероприятий ведомственного санкционирования, а также установление различий между нормативно-закрепленными задачами и теми, которые фактически выполняются в процессе проведения таких мероприятий.
