Правовий статус Кабінету Міністрів України та центральних органів виконавчої влади як державних суб’єктів захисту об’єктів критичної інфраструктури в Україні

Abstract

Визначено правовий статус таких державних суб’єктів захисту об’єктів критичної інфраструктури в Україні як Кабінету Міністрів України та центральних органів виконавчої влади. Встановлено, що у випадку аналізу правового статусу будь-якого державного суб’єкта, в контексті здійснення ним владної діяльності, необхідно говорити не про сукупність його суб’єктивних прав та юридичних обов’язків, а про його повноваження. Висвітлено функції й основні повноваження міністерств та інших центральних органів виконавчої влади.In the article, it has been emphasized that one of the most numerous groups of subjects of protection of critical infrastructure objects are state subjects, as they are the ones most responsible for the proper functioning of the state as a whole and ensuring the state of protection of a single critical infrastructure object. It has been noted that a necessary condition for acquiring the legal status of the relevant, including state, subject of protection of critical infrastructure is the possession of a certain amount of administrative legal personality. The legal status of such state subjects of protection of critical infrastructure objects in Ukraine as the Cabinet of Ministers of Ukraine and central executive bodies has been considered. It has been established that in the case of analysis of the legal status of any state entity, in the context of its power activities, it is necessary to talk not about the set of its subjective rights and legal obligations, but about its powers. It have been singled out the following powers of the Cabinet of Ministers of Ukraine as a state subject of protection of critical infrastructure objects: financial support for the functioning of the administrative and legal mechanism for the protection of critical infrastructure; in the field of environmental protection and emergency response; control powers; scientific support for the functioning of the administrative and legal mechanism for the protection of critical infrastructure; information and analytical support for the functioning of the administrative and legal mechanism for the protection of critical infrastructure; ensuring national security; staffing the functioning of the administrative and legal mechanism for the protection of critical infrastructure. The functions and main powers of the committees of the ministries and other central executive bodies have been highlighted.Определен правовой статус таких государственных субъектов защиты объектов критической инфраструктуры в Украине как Кабинета Министров Украины и центральных органов исполнительной власти. Установлено, что в случае анализа правового статуса любого государственного субъекта в контексте осуществления им властной деятельности необходимо говорить не о совокупности его субъективных прав и юридических обязанностей, а о его полномочиях. Освещены функции и полномочия министерств и других центральных органов исполнительной власти.
