До характеристики завдань та функцій Національної гвардії України як суб’єкта правоохоронної діяльності

Abstract

У статті акцентовано увагу на тому, що завдання та функції слід вважати визначальними елементами адміністративно-правового статусу Національної гвардії, оскільки саме на основі останніх формуються повноваження та компетенція цього відомства за відповідним напрямом. Запропоновано авторське бачення щодо завдань та функцій Національної гвардії України як правоохоронного органу.

It was found that the tasks of the National Guard represent certain instructions in the form of a specification of the main goal of activity - ensuring law and order and security, while the functions represent the main directions of the influence of the National Guard’s activities on the sphere of certain social relations on the way to the fulfillment of the specified tasks. Therefore, we can say that there is a direct conditionality of the tasks and functions of the National Guard. It is argued that the tasks of the National Guard of Ukraine as a subject of law enforcement activity are most appropriate to include: protection of state sovereignty, territorial integrity and inviolability of Ukraine, fight against terrorism, crime and other threats to national security; ensuring public order and security, in particular during mass, sports events, concerts, international events, etc.; support and assistance to other law enforcement agencies in the event of emergency situations that may harm the life and health of citizens; taking part in the liquidation of emergency situations, in particular: natural, manmade, etc.; protection of critical infrastructure facilities such as: energy facilities, important communications, transport facilities, etc.; implementation of preventive measures related to the commission of offenses, provocations at the state border, etc. The following functions of the National Guard of Ukraine as a law enforcement body have been developed: first, the main functions that reveal the purpose of the National Guard as a military formation with law enforcement functions, and they, in turn, can be divided into several groups based on an understanding of the task-driven focus of activity: a) current functions directly related to the protection of life and health of citizens; b) functions regarding the ongoing protection of objects that are particularly important for the social order; c) crisis functions that are associated with social processes of a destructive nature; d) crisis functions are related to ensuring law and order caused by technological and natural negative processes; e) law enforcement and restorative functions; e) functions related to countering external aggression. Implementation of auxiliary functions by the National Guard allows to ensure that the National Guard performs its main functions; secondly, auxiliary functions, which are: organizational, informational-analytical, rulemaking, social security, personnel-training, controlsupervisory, financial-material, patriotic-educational, functions of international and interdepartmental cooperation, and others.

В статье акцентировано внимание на том, что задачи и функции следует считать определяющими элементами административно-правового статуса Национальной гвардии, поскольку именно на основе последних формируются полномочия и компетенция этого ведомства по соответствующему направлению. Предложено авторское видение задач и функций Национальной гвардии Украины как правоохранительного органа.
