А саме досліджені проблемні аспекти, пов’язані з порушенням вимог щодо предмета даного договору, термінів його виконання і перерахунку ціни. Які тягнуть за собою не лише негативні матеріальні наслідки для інвестора, але і є наслідком неналежного виконання зобов’язання.The article presents legal analysis of the characteristics of the essential conditions of construction contracts investment. Namely investigated were problematic aspects related to the violation of the requirements to the subject of the contract, the terms of its execution and the recalculation of prices. That entails not only the adverse material consequences for the investor, but is the result of improper performance of an obligation. In this connection, special attention is given to scrupulous detail of the subject of the contract (apartment kind, size, type, floor, address, district, etc.), and compliance with the order of mutual payment of the parties. In particular, the article concludes that one-time nature of the undertaking is inherent to the investment contracts for the construction of housing in terms of its performance as a whole, and multiple – if you isolate the fact that the investor pays the amount of the contract, at the expense of the future apartment, step by step. No less important for this kind of contract is the price, which is the cost of construction, which can cause a number of «pitfalls», namely tolerance variation and the inflation index to which you should pay particular attention when signing the contract. Thus, having the information about the features of the material terms of these agreements, it is possible to protect the investor from construction scams and minimize his or her financial losses.В статье осуществлен правовой анализ особенностей существенных условий инвестиционных договоров на строительство жилья. Исследованы проблемные аспекты, связанные с нарушением требований относительно предмета данного договора, сроков его выполнения и пересчета цены, которые влекут за собой не только негативные материальные последствия для инвестора, но и являются следствием ненадлежащего исполнения обязательства.otherЦивільне право.
