Розглянуто види житлових прав, систему цивільно-правових засобів захисту житлових прав, їх співвідношення зі способами у межах судового порядку захисту цивільних прав. Визначено, що цивільно-правові засоби захисту житлових прав – це система юридичних інструментів (заяв, скарг), за допомогою яких здійснюється відновлення порушених або оспорюваних житлових прав, усунення наслідків такого порушення та визнання житлових прав. Запропоновано засади побудови самостійної системи цивільно-правових засобів захисту житлових прав.Theoretical and legal principles of building a system of civil and legal means of protecting housing rights are researched in the article. The article’s objective is establishment of a system of civil and legal means of protecting housing rights on the basis of allocating housing rights’ features among other civil rights and analysis of the existing means used in the courts to protect the rights and can be applied to protect housing rights. Types of housing rights, the system of civil and legal means of protecting housing rights, their correspondence with the methods within the court procedure of protecting civil rights have been considered. The author has determined the lawsuits to protect housing rights: 1) on recognizing the right of using housing premises; 2) on the compulsory exchange of housing premises; 3) on providing housing by registration of citizens who need better housing conditions; 4) on the removal from the register of residence; 5) on the management of housing (apartment buildings); 6) on the maintenance of housing; 7) on the eviction from housing; 8) on damages reimbursement caused to housing or damage caused by a violation of tenure; 9) on ensuring the housing rights of dormitory residents; 10) about other requirements associated with the use of housing (receipt, retention, termination of rights for housing). It is established that civil and legal means of protecting housing rights – is a system of legal instruments (applications, complaints), through which the restoration of violated or disputed housing rights is realized, elimination of the consequences of such violation and recognition of housing rights. Civil and legal means of protection of housing rights depending on the principle of building relationships can form two systems. The first system is built according to legal regulation of the means of protecting housing rights. The second system of civil and legal means of protecting housing rights may be formed depending on the subject matter of protection.Исследованы теоретико-правовые основы построения системы гражданско-правовых средств защиты жилищных прав. Рассмотрены виды жилищных прав, система гражданско-правовых способов защиты жилищных прав, их соотношение со способами в пределах судебного порядка защиты гражданских прав. Определено, что гражданско-правовые способы защиты жилищных прав – это система юридических документов (заявлений, жалоб), с помощью которых осуществляется восстановление нарушенных или оспариваемых жилищных прав, устранение последствий такого нарушения и признания жилищных прав.
