Наголошено, що предметом незаконної порубки і контрабанди лісу, вчиненої організованою злочинною групою, є сиророслі та сухостійні дерева чи чагарники, що ростуть у лісах, захисних та інших лісових насадженнях, у заповідниках або на територіях та об’єктах природно-заповідного фонду.The purpose of the article is to determine, taking into account the specifics of the mechanism of commission by an organized criminal group of illegal logging and smuggling of forest typical features of the subject of these criminal offenses. In the article has been emphasized that without clarifying the essence of the subject of illegal logging and smuggling of forests committed by an organized criminal group, it is difficult, if not impossible, to correctly establish all the public relations to which criminal encroachment is directed. It has been noted that the forensic significance of the subject of illegal logging and smuggling of forests committed by an organized criminal group is the ability to establish patterns between elements of the mechanism of the crime and build the right course of action during its pre-trial investigation. It has been specified that the subject of the criminal offense provided by Art. 2011 and 246 of the Criminal Code of Ukraine, defined in the title of these rules of law and detailed in their dispositions. It has been emphasized that the subject of smuggling is the forest in the form of raw timber, and not timber and/or lumber, because, in fact, under the guise of timber exports roundwood, including valuable and rare species of trees. It has been emphasized that the subject of illegal logging and smuggling of forests by an organized criminal group are raw and dead trees or shrubs growing in forests, protective and other forest plantations, reserves or areas and objects of nature reserves. According to the results of the study of the materials of criminal proceedings in relation to the criminal offenses committed by organized criminal groups, criminal offenses under Art. 2011 and 246 of the Criminal Code of Ukraine, in 98,11 % of cases the subject of the crime were trees, and 1,89 % – shrubs. The main mass share falls on hardwood trees (59,43 %) of oak, beech, birch, ash, alder, and much less on conifers (38,7 %) of pine, spruce, fir.Отмечено, что криминалистическое значение предмета незаконной порубки и контрабанды леса, совершенной организованной преступной группой, заключается в возможности устанавливать закономерности между элементами механизма совершения преступления и строить верную линию поведения при его досудебном расследовании. Подчеркнуто, что предметом незаконной порубки и контрабанды леса, совершенной организованной преступной группой, являются сырорастущие и сухостойные деревья или кустарники, произрастающие в лесах, защитных и других лесных насаждениях, в заповедниках или территориях и объектах природно-заповедного фонда.ukКриміналістика.
