Криміналізація відбувається шляхом з’ясування цілей, підстав становлення кримінальної відповідальності за діяння, вчинене проти власності. На підставі цього формується сукупність норм кримінального права, які містять перелік злочинів і передбачених за них покарань, а також підстав та умов притягнення до кримінальної відповідальності винних осіб чи звільнення від неї.The article explores the grounds and principles of criminalization of acts against property. Criminalization occurs by fnding out the purposes, grounds for criminal liability for an act against property. On this basis, a set of criminal law norms is formed, which contains the list of crimes and the punishments provided for by them, as well as the grounds and conditions for bringing to justice or acquitting perpetrators. The main grounds for criminalizing acts against property are that public property relations, as part of economic relations, form the basis of the functioning of any society, the development of which is impossible without proper protection of property, the rights of the owner against any unlawful encroachment. In case of any change of the current criminal legislation, it is necessary to consider the principles of criminalization as the most abstract and general level of provision and justifcation of criminal law-making. The criminal law classifcation of principles of criminalization of actions is considered. Social and socio-psychological principles ensure the social adequacy of criminalization, its admissibility in terms of the main characteristics of social systems and processes of social development, compliance with the criminal law level, the nature of public consciousness and the state of public opinion. The system-legal principles of criminalization are determined by the requirement of internal logical consistency of the system of criminal law norms. Social and social-psychological principles, in turn, cover the principles of social danger, relative prevalence of action, positive and negative consequences of criminalization, criminal-political adequacy of criminalization. The application of a criminal law that is formed without taking into account the principles of criminalization will lead to negative consequences, which are connected with unreasonable prosecution. Property crimes make up the largest proportion of offenses in the country. This situation remains unchanged throughout the years of Ukraine’s independence, and accordingly requires constant control by the state and society. Fixing at the legislative level the rules of criminal law, which contain a list of crimes against property and punishment for them, is considered as the most effective form of social control.В статье исследованы основания и принципы криминализации деяний против собственности. Криминализация происходит путем выяснения целей, оснований становления уголовной ответственности за деяние, совершенное против собственности. На основании этого формируется совокупность норм уголовного права, содержащие перечень преступлений и предусмотренных за них наказаний, а также оснований и условий привлечения к уголовной ответственности виновных лиц или освобождения от нее.otherКримінальне право.
