Дідоренка 3 (2016): 125-133.Відповідно до реалій практики й законодавства у статті зроблено спробу надати авторське бачення щодо сучасної диференціації форм оперативно-розшукової діяльності у протидії злочинності. Виходячи з аналізу наукових поглядів учених, практичної діяльності кримінальної поліції та емпіричного матеріалу зроблено умовивід про те, що сьогодні форми оперативно-розшукової діяльності можна диференціювати таким чином: 1) оперативний пошук первинної оперативно-розшукової інформації; 2) оперативно-розшукова превенція; 3) оперативно-розшукове забезпечення кримінального провадження.The study found that the spread of crime was before and is still quite important for Ukrainian society and requires an immediate response from the authorized state police. The first step is to realize that the process of building a sovereign state is impossible without effective work of law enforcement bodies, without proper effective legal institutions, without the use of all available opportunities and modern organizational and tactical forms of operational activities. It is proved that in the operational activities significant contribution to the study of this issue made national and foreign scientists. However, most scholars and practitioners of developments related to the differentiation of search operations forms of combating crime, updating criminal procedural and operational-search laws need revision and reconsideration given the current realities. Therefore, the proposed article to a certain extent directed at further improvement of theoretical and applied aspects of differentiation forms of operational activities. Analysis of the opinions of scholars and practitioners reveals that that the vast majority adheres formed in the Soviet period concept, according to which operational (intelligence) development of a form of investigative activity. Given the empirical material analyzed, the realities of practice criminal police units, recent changes in criminal procedural and operational-search legislation concluded feasibility rethinking the established perception rapid development as a form of investigative and assigning it to one of the elements of existing forms of OSA. In accordance with the realities of practice and legislation in the article attempts to copyright vision of contemporary forms of differentiation of operational activities in combating crime. Based on the analysis of scientific views of scholars, criminal police practice and empirical inference is made that the present form of operational activities can be differentiated as follows: 1) initial operational search of operational information; 2) operational-search prevention; 3) providing operational search criminal proceedings.В соответствии с реалиями практики и законодательства в статье предпринята попытка предоставить авторское видение современной дифференциации форм оперативно-розыскной деятельности в противодействии преступности. Исходя из анализа научных взглядов ученых, практической деятельности криминальной полиции и эмпирического материала сделано умозаключение о том, что сегодня формы оперативно-розыскной деятельности можно дифференцировать следующим образом: 1) оперативный поиск первичной оперативно-розыскной информации; 2) оперативно-розыскная превенция; 3) оперативно-розыскное обеспечение уголовного производства.otherКримінально-процесуальне право.
