Визначено поняття хуліганського мотиву вбивства. Обґрунтовано, що встановлення і дослідження мотиву вбивства є необхідною умовою повного та якісного розслідування злочинів вказаної категорії. Факторами формування хуліганського мотиву виступають потреби, інтереси, емоції, установки та особливості конкретної ситуації.The article is devoted to hooligan motive for committing murder as an element of its forensic characteristics. The analysis of the crime motive in its general form is conducted. Having analyzed scientific thoughts and peculiarities of forming hooligan motive the author defined the concept of hooligan motive of a murder. It is established that the factors of forming hooligan motive are the needs, interest, emotions, attitudes and specific situation. Hooligan motive for committing a murder is based on the needs of an offender in the attention to his personality and demonstration of own superiority over the others. At the heart of murders with hooligan motives also lie emotions that affect impulsive decisions to commit a wrongful act by an offender in a particular situation. Provoke the commission of an offense can unimportant occasion formed in a particular situation and cause offender’s strong emotions. It is grounded that the establishment and research of a motive for committing a murder is essential condition for the full and qualitative investigation of such offenses. This is due to the fact that the motive not only affects the classification of the act and is the obstacle to be proven in criminal proceedings, but also has the inextricable link with other elements of forensic characteristics. It is determined that detecting hooligan motive of a murder it is possible to fully explore perpetrator’s identity and to determine the specific behavior of a criminal that could provoke a crime.Проанализирован вопрос установления мотива преступления в его общем виде и особенности формирования хулиганского мотива. Определено понятие хулиганского мотива убийства. Обосновано, что установление и исследование мотива убийства является необходимым условием полного и качественного расследования преступлений указанной категории.
