Форум права 5 (2017): 259–264.Проаналізовано наукові підходи до визначення компетенції органів державної влади, зокрема, органів досудового розслідування Національної поліції. Розглянуто компетенцію як комплексний елемент адміністративного права. Виокремлено складові компетентності органів досудового розслідування Національної поліції – владних повноважень, юридичної відповідальності й елементів відання, та наведено їх теоретико-правову характеристику.The article analyzes the scientific approaches to the definition of the competence of public authorities, in particular, the bodies of pre-trial investigation of the National Police. Today, the notion of competence in the field of law applies only to public authorities - representatives of public power, which is expressed in the right to professional activities within certain limits. It has been established that competence is a category of law to determine the extent of the rights and powers of a state body. By securing the appropriate body, the prohibition is allowed to go beyond its borders and interfere with other bodies in a certain area. Competence considered as a complex element of administrative law: 1) certain powers that are assigned to the subject at the legislative level; 2) professional knowledge, information that the subject possesses at a high level; 3) motives, which are advanced to a future specialist in a certain field of knowledge. The competence of the pre-trial investigation bodies is determined by the Criminal Procedural Code of Ukraine and the Order «On the organization of the activities of the bodies of pre-trial investigation of the National Police». It has been established that a systematic approach should be used to effectively allocate authority competences and ensure the effective functioning of pre-trial investigation bodies. The provision of competences will be successful provided when the authorities and their institutions are stable; correct regulation of competences (and authorities, in particular), namely avoiding duplication between different authorities/departments; appropriate high and qualified competence of senior executives and staff of the National Police, as well as material support and incentives. At the same time, the term «competence» itself is not legally defined clearly, therefore, the definition of the content of this concept and to date remains the subject of discussion in legal science and needs further analysis.Проанализированы научные подходы к определению компетенции органов государственной власти, в частности, органов досудебного расследования Национальной полиции. Рассмотрено компетенцию как комплексный элемент административного права.
